Federal constitutional complaint for denial of free legal aid in a payment claim fails for lack of substantiation
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Tribunal (First Civil Law Court) dismissed the appellant’s constitutional complaint and declined to enter into the merits, ordering no judicial costs. The contested cantonal decision denying the appellant’s request for free legal assistance in a payment action therefore remains in force against the appellant. The appellant challenged a lower court ruling that had rejected his application for legal aid in connection with a debt collection claim filed against the respondent. The complaint was held inadmissible because it did not comply with statutory reasoning requirements: the appellant failed to identify any specific constitutional right allegedly violated or to explain how the cantonal court’s ruling breached it. The decision is based on Article 42(2) of the Federal Act on the Federal Supreme Court (LTF) governing the mandatory content of appeals, Articles 116 and 117 LTF (constitutional complaint grounds), and Article 106(2) LTF, leading to simplified dismissal under Article 108(1)(b) LTF.

Objet
assistance judiciaire gratuite,
Vu l'arrêt du 1er avril 2008 par lequel la Cour civile du Tribunal cantonal du canton du Jura a rejeté le recours formé par X.________ contre le jugement du 20 février 2008 au terme duquel le Tribunal de première instance dudit canton avait rejeté la requête à fin d'assistance judiciaire gratuite présentée par le prénommé dans le cadre d'une action en paiement introduite par lui, le 17 septembre 2007, contre Y.________;
Vu le recours formé le 19 avril 2008 par X.________ contre cet arrêt;
116 LTF ; art. 117 LTF en liaison avec l' art. 106 al. 2 LTF ),
qu'il n'est, dès lors, pas possible d'entrer en matière, ce qui peut être constaté en procédure simplifiée ( art. 108 al. 1 let. b LTF );
