Constitutional complaint against late cantonal appeal dismissed for failure to substantiate arbitrary application of law.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Tribunal did not enter into the merits of the appellant's constitutional complaint and thereby upheld the cantonal appellate court's decision, which had dismissed the appellant's previous appeal as untimely. The underlying dispute concerned a default judgment issued in a civil case, from which the appellant had appealed one day after the statutory deadline; the cantonal court rejected that appeal, finding no force-majeure excuse. In the federal appeal, the appellant alleged arbitrary application of various administrative-procedure and constitutional provisions, but the Tribunal found the complaint manifestly failed to meet the statutory substantiation requirements, as the cited norms were irrelevant to the challenged ruling and no proper argument of constitutional violation was made. Consequently, the court applied its simplified procedure, waived judicial costs, and awarded no costs to the respondent, who had not been invited to respond.

Objet
