KI-generiert

The case involves a dispute where eviction proceedings were initiated against two individuals by a landlord. A lower court had approved the eviction, which was subsequently challenged by the defendants in a higher court. However, their appeal was declared inadmissible due to lack of proper documentation. The defendants then appealed to a higher tribunal, seeking to suspend the eviction process while they sought assistance for finding new housing. The appeal was ultimately deemed insufficiently motivated, leading to its dismissal.

Sentenza del 3 aprile 2012

I Corte di diritto civile

Composizione

Giudice federale Klett, Presidente,

Cancelliere Piatti.

Partecipanti al procedimento

A.________ e B.________,

ricorrenti,

contro

C.________,

opponente.

Oggetto

sfratto,

ricorso in materia costituzionale contro la sentenza emanata il 10 febbraio 2012 dalla II Camera civile

del Tribunale d'appello del Cantone Ticino.

Considerando:

che con decisione 11 gennaio 2012 il Pretore del distretto di Lugano ha accolto l'istanza di sfratto presentata dalla C.________ nei confronti di A.________ e B.________, disponendone l'esecuzione effettiva;

che con sentenza 10 febbraio 2012 la II Camera civile del Tribunale di appello del Cantone Ticino ha dichiarato improponibile, per carenza di motivazione, un appello presentato dai convenuti;

che contro la predetta sentenza B.________ e A.________ sono insorti al Tribunale federale con ricorso del 29 febbraio 2012, postulando la sospensione della procedura di sfratto fino alla ricezione dell'aiuto chiesto al Cantone;

che, in quanto rivolto contro una decisione pronunciata nel quadro di una causa civile di carattere pecuniario concernente una controversia in materia di diritto della locazione, il cui valore litigioso non raggiunge fr. 15'000.-- (art. 51 cpv. 2 e 74 cpv. 1 lett. a LTF; sulla determinazione del valore litigioso minimo quando controverso è solo lo sfratto e non anche la disdetta cfr. sentenza 4A_107/2007 del 22 giugno 2007 consid. 2.3, non pubblicato in DTF 133 III 539 ) e il cui contenuto non riguarda una questione di diritto d'importanza fondamentale ( art. 74 cpv. 2 lett. a LTF ), lo scritto dei ricorrenti può venir tenuto in considerazione solo quale ricorso sussidiario in materia costituzionale, disciplinato dall'art. 113 segg. LTF;

che con un tale rimedio può solo essere fatta valere la violazione di diritti costituzionali ( art. 116 LTF ) e che nell'atto di ricorso il ricorrente deve indicare, confrontandosi con i considerandi della sentenza impugnata, quali diritti costituzionali sono stati violati dalla Corte cantonale (art. 42 cpv. 2 e art. 106 cpv. 2 richiamato dall' art. 117 LTF ; DTF 134 II 244 consid. 2.1);

che nella fattispecie il ricorso non soddisfa le predette esigenze di motivazione, i ricorrenti non prendendo in alcun modo posizione sull'argomentazione della sentenza impugnata, limitandosi a descrivere le difficoltà incontrate nella ricerca di un nuovo alloggio;

che pertanto il ricorso, insufficientemente motivato, si rivela inammissibile e va deciso dalla Presidente della Corte adita nella procedura semplificata ( art. 108 cpv. 1 lett. b LTF );

per questi motivi, la Presidente pronuncia:

1. Il ricorso è inammissibile.
