Work contract payment claim; constitutional complaint inadmissible for failure to exhaust mandatory cantonal appeal allowing full review.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court declined to hear the claimant's appeal and did not impose court costs, thereby leaving the lower court's decision against the claimant in force. The underlying dispute involved a work contract claim by the opposing party seeking payment of approximately 4,115.35 Swiss francs plus interest and removal of a legal objection in a debt collection proceeding. The claimant filed a constitutional complaint against a district court decision, but the Supreme Court ruled the appeal inadmissible because the challenged decision was not a final cantonal instance, as a cantonal appeal allowing full review under Articles 95 ff. of the Federal Supreme Court Act was available and had been filed. The court based its ruling on Articles 75(1) and 113 of the Federal Supreme Court Act, treating the appeal as procedurally premature, and waived court fees under Article 66(1) while denying the opposing party compensation due to no incurred expenses.

Verfahrensbeteiligte
A.________,
Beschwerdeführer,
gegen
X.________ AG,
Beschwerdegegnerin.
Gegenstand
Werkvertrag,
Verfassungsbeschwerde gegen den Entscheid des Bezirksgerichts Steckborn vom 24. Juni 2010.
Die Präsidentin hat in Erwägung,
dass der Einzelrichter am Bezirksgericht Steckborn mit Entscheid vom 24. Juni 2010 eine Klage der Beschwerdegegnerin gegen den Beschwerdeführer schützte, mit dem sie von diesem die Bezahlung von Fr. 4'115.35 nebst 6% Zins seit 1. Januar 2009 sowie der Betreibungskosten und die Beseitigung des Rechtsvorschlags in der angehobenen Betreibung verlangt hatte;
dass der Beschwerdegegner gegen diesen Entscheid beim Bundesgericht Beschwerde erhob;
dass beim Bundesgericht nur gegen kantonal letztinstanzliche Entscheide Beschwerde geführt werden kann ( Art. 75 Abs. 1 und Art. 113 BGG );
dass gegen den angefochtenen Entscheid die kantonalrechtliche Berufung, mithin ein Rechtsmittel, das die Erhebung von allen Rügen nach den Artikeln 95 ff. BGG erlaubt, zulässig ist und gemäss Mitteilung der Bezirksgerichtskanzlei Steckborn auch erhoben wurde;
dass demnach auf die erhobene Beschwerde mangels kantonaler Letztinstanzlichkeit des angefochtenen Entscheids nicht einzutreten ist;
dass ausnahmsweise auf die Erhebung von Gerichtskosten zu verzichten ist (Art. 66 Abs. 1 zweiter Satz BGG);
dass der Beschwerdegegnerin keine Parteientschädigung zuzusprechen ist, da ihr im Zusammenhang mit dem bundesgerichtlichen Verfahren kein Aufwand erwachsen ist ( Art. 68 Abs. 1 BGG );
im Verfahren nach Art. 108 Abs. 1 lit. a BGG erkannt:
1. Auf die Beschwerde wird nicht eingetreten.
2. Es werden keine Gerichtskosten erhoben.
3. Dieses Urteil wird den Parteien und dem Bezirksgericht Steckborn schriftlich mitgeteilt.
