Contract for Work–Appeal Withdrawal under Art. 32 BGG
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court struck the case from the record as moot after the appellant withdrew its appeal (Art. 32 para. 2 BGG). The Court ordered the appellant to bear the court costs of CHF 500 and granted no compensation to the respondent, as no reimbursable expenses had accrued. The underlying dispute concerned a contract for work (Werkvertrag); the appeal challenged a judgment and decision of the Zurich Commercial Court of 9 January 2019. The withdrawal terminated the proceedings, leaving the lower court's decision in force.
