Withdrawal of Appeal in Debt Non-Existence Action Execution Suspension Case
Legislator-Zusammenfassung
KI-generiertWithdrawal of Appeal in Debt Non-Existence Action Execution Suspension Case The Federal Supreme Court case concerns an appeal initially challenging a cantonal court's refusal to suspend execution proceedings, where the lower court had upheld the denial of an application for suspension within a debt non-existence action. However, the appellant subsequently withdrew their appeal to the Federal Supreme Court after initiating the proceedings. Consequently, the Federal Supreme Court ordered the case to be removed from the court roll due to the withdrawal of the appeal and assigned the costs, set at a reduced judicial fee of CHF 200, to the appellant in accordance with the principle that the withdrawing party bears the expense.
