KI-generiert

The case involves a civil appeal regarding the suspension of execution related to an order to provide specific documents and corporate records to two opposing parties. Initially, a local court had suspended these execution measures in response to a request made by the appellant, who complied with prior injunctions. However, the Cantonal Court dismissed the appellant's subsequent challenge to this decision. The appellant then escalated the matter to the Federal Tribunal, seeking relief and a suspensive effect on their appeal. Nevertheless, the Federal Tribunal found the appeal inadmissible due to the appellant's failure to pay the required advance costs within the specified timeframe, leading to an automatic dismissal of the case.

Sentenza dell'8 luglio 2013

I Corte di diritto civile

Composizione

Giudice federale Klett, Presidente,

Cancelliere Piatti.

Partecipanti al procedimento

A.________,

ricorrente,

contro

1. B.________SA,

2. C.________SA ,

entrambe patrocinate dall'avv. Matteo Galante,

opponenti.

Oggetto

sospensione dell'esecuzione,

ricorso contro la sentenza emanata il 10 dicembre 2012 dalla I Camera civile del Tribunale d'appello del

Cantone Ticino.

Considerando:

che il 28 ottobre 2011, in parziale accoglimento di un'istanza presentata da A.________ e tendente alla soppressione ex tunc delle misure di esecuzione concernenti l'ordine di consegnare alla B.________SA e alla C.________SA una serie di specificati documenti e tutta la documentazione societaria e contabile, il Pretore del distretto di Lugano ha sospeso definitivamente dal 27 settembre 2011 tali misure, perché il 28 settembre 2011 l'istante aveva ottemperato alle relative ingiunzioni;

che con sentenza 10 dicembre 2012 la I Camera civile del Tribunale di appello del Cantone Ticino ha respinto, nella misura in cui era ricevibile, un reclamo presentato da A.________ contro la decisione del 28 ottobre 2011;

che A.________ ha impugnato con ricorso in materia civile del 31 gennaio 2013 al Tribunale federale la sentenza cantonale, postulando pure il conferimento dell'effetto sospensivo al gravame;

che con risposta 27 febbraio 2013 la B.________SA e la C.________SAhanno proposto la reiezione sia dell'istanza di conferimento dell'effetto sospensivo sia del ricorso;

che il 15 marzo 2013, dopo aver ricevuto un primo invito a versare un anticipo spese di fr. 2000.--, la ricorrente ha chiesto di essere posta al beneficio dell'assistenza giudiziaria e che tale domanda è stata respinta dalla Corte adita con decreto del 6 giugno 2013;

che l'11 giugno 2013 è stato impartito alla ricorrente il termine suppletorio dell' art. 62 cpv. 3 LTF per effettuare il predetto pagamento entro il 24 giugno 2013;

che il 5 luglio 2013 la Cassa del Tribunale federale ha constatato che il richiesto anticipo spese non è stato pagato né accreditato sul suo conto postale e che non le è pervenuto alcun avviso di addebito di un conto bancario o postale;

che in queste circostanze il ricorso si rivela manifestamente inammissibile per mancato tempestivo pagamento dell'anticipo spese ( art. 48 cpv. 4 LTF ) e va deciso dalla Presidente della Corte adita nella procedura semplificata ( art. 108 cpv. 1 lett. a LTF );

che le spese giudiziarie e le ripetibili seguono la soccombenza (art. 66 cpv. 1 e 68 cpv. 1 LTF);

per questi motivi, la Presidente pronuncia:

1. Il ricorso è inammissibile.
