Legislator-Zusammenfassung

KI-generiert

In this case, a request for provisional evidence was filed by one party against another, which was accepted by the President of the Civil Court of Appeal of a canton. The opposing party subsequently appealed this decision to the Swiss Federal Tribunal, seeking its annulment. The appeal was based on an alleged violation of federal law; however, the appealing party did not raise any specific constitutional rights being violated. As a result, the Swiss Federal Tribunal deemed the appeal manifestly insufficiently substantiated and therefore inadmissible, leading to a decision in favor of the initial ruling.

Sentenza del 17 dicembre 2015

Composizione

Giudice federale Kiss, Presidente,

Oggetto

assunzione di prove a titolo cautelare,

ricorso contro la decisione emanata il 6 novembre 2015 dal Presidente della III Camera civile del Tribunale d'appello del Cantone Ticino.

Considerando:

che il Presidente della III Camera civile del Tribunale di appello del Cantone Ticino ha accolto, con giudizio del 6 novembre 2015, l'istanza di assunzione di prove a titolo cautelare del 16 marzo 2015 promossa dalla B.________Lda nei confronti di A.________;

che A.________ è insorto al Tribunale federale con ricorso in materia civile del 7 dicembre 2015, postulando l'annullamento della predetta decisione;

che non è stato ordinato uno scambio di scritti;

che i giudizi su domande di assunzione di prove a titolo cautelare sono decisioni cautelari nel senso dell' art. 98 LTF contro le quali il ricorrente può unicamente invocare una violazione di diritti costituzionali ( DTF 138 III 46 consid. 1.1, 555 consid. 1);

che giusta l' art. 106 cpv. 2 LTF il Tribunale federale esamina la violazione di diritti fondamentali e costituzionali soltanto se il ricorrente ha sollevato e partitamente motivato tale censura (v. sulle esigenze di motivazione di un ricorso diretto contro una misura cautelare DTF 135 III 232 consid. 1.2);

che nella fattispecie il ricorrente, pur menzionando l' art. 98 LTF , si limita a prevalersi di una semplice violazione del diritto federale e segnatamente dell' art. 158 CPC , ma omette di indicare un qualsiasi diritto costituzionale reputato violato;

che pertanto il ricorso, manifestamente non motivato in modo sufficiente, si rivela inammissibile e va deciso dalla Presidente della Corte adita nella procedura semplificata ( art. 108 cpv. 1 lett. a LTF );

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, la Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Le spese giudiziarie di fr. 500.-- sono poste a carico del ricorrente.

3. Comunicazione ai patrocinatori delle parti e al Presidente della III Camera civile del Tribunale d'appello del Cantone Ticino.

Losanna, 17 dicembre 2015

del Tribunale federale svizzero
