In this case, a party was ordered by a lower court to pay a significant amount in a loan dispute. Following the initial ruling, an appeal to a higher court was dismissed. The losing party subsequently filed a complaint with the Federal Tribunal. However, the Federal Tribunal required the appealing party to provide a deposit to cover court costs and specify a Swiss address for notifications due to being domiciled abroad. The required deposit was not made, nor was an address provided, leading the Tribunal to determine that it could not proceed with examining the appeal. As a result, the appeal was declared inadmissible without incurring any judicial costs.

Sentenza del 27 marzo 2017

I Corte di diritto civile

Composizione

Giudice federale Kiss, Presidente,

Cancelliere Piatti.

Partecipanti al procedimento

A.________,

ricorrente,

contro

B.________,

opponente.

Oggetto

prestito,

ricorso contro la sentenza emanata il 10 ottobre 2016

dalla II Camera civile del Tribunale d'appello del Cantone

Ticino.

Considerando:

che il 24 giugno 2014, in accoglimento della petizione presentata da B.________ nei confronti di A.________, il Pretore del distretto di Blenio ha condannato il convenuto a pagare all'attore fr. 155'000.--, oltre interessi;

che con sentenza 10 ottobre 2016 la II Camera civile del Tribunale di appello del Cantone Ticino ha respinto, nella misura in cui era ammissibile, l'appello presentato da A.________;

che quest'ultimo è insorto al Tribunale federale con ricorso del 14 novembre 2016;

che giusta l'art. 39 cpv. 3 primo periodo LTF le parti domiciliate all'estero devono designare un recapito in Svizzera;

che il 23 novembre 2016 il Tribunale federale ha chiesto alla competente autorità del domicilio germanico indicato dal ricorrente sul ricorso di notificare a quest'ultimo il decreto della medesima data con cui viene invitato a versare entro il termine di 30 giorni un anticipo spese di fr. 5'500.-- e a designare un recapito in Svizzera con l'avvertimento che in caso d'inottemperanza le notificazioni del Tribunale federale possono essere omesse o avvenire mediante pubblicazione in un foglio ufficiale;

che il 23 dicembre 2016 l'autorità richiesta ha comunicato al Tribunale federale di non aver potuto eseguire la notifica perché il ricorrente ha lasciato la Germania;

che al ricorrente è stato concesso un termine suppletorio di 20 giorni per provvedere al versamento del predetto anticipo spese con decreto pubblicato nel Foglio federale del 14 febbraio 2017 (art. 39 cpv. 3 secondo periodo e 63 cpv. 2 LTF);

che il 24 marzo 2017 la Cassa del Tribunale federale ha constatato che il richiesto anticipo non è stato pagato né accreditato sul suo conto postale e che non le è pervenuto alcun avviso di addebito di un conto bancario o postale;

che in queste circostanze il Tribunale federale non può entrare nel merito del gravame (art. 48 cpv. 4 e 62 cpv. 3 LTF);

che giusta l' art. 108 cpv. 1 lett. a LTF il Presidente della Corte decide in procedura semplificata i ricorsi manifestamente inammissibili;

che eccezionalmente si rinuncia a prelevare spese giudiziarie;

per questi motivi, la Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Non si prelevano spese giudiziarie.

3. Comunicazione all'opponente e alla II Camera civile del Tribunale di appello del Cantone Ticino. Un esemplare di questa sentenza si trova a disposizione del ricorrente presso il Tribunale federale.
