Inadmissibility of Appeal Due to Untimely Payment of Security
Legislator-Zusammenfassung
KI-generiertIn this case, a petitioner filed for redress following a decision by a lower court regarding a claim related to non-provision of advance costs. The petitioner was required to deposit a security of 2,000 Swiss francs by a specified deadline to proceed with the appeal. However, the security was not deposited within the allotted time, leading to the conclusion that the appeal was inadmissible based on the established court procedures. Consequently, no costs were awarded to the opposing party, and the petitioner was ordered to pay a judicial fee.

KI-generiertThis provision (or its equivalent under the OJ, although the output only extracts explicitly cited references; in this case, the costs order refers to standard practice, but Art. 66 LTF is the modern equivalent often cited for costs; however, looking strictly at the dispositive: the decision imposes judicial fees in section 2, which is generally governed by procedural rules on costs. Given that the decision explicitly cites Art. 150 al. 4 OJ for inadmissibility, and the costs are handled by section 2 and 3, we must check if any explicit cost article is cited in the dispositive. The dispositive orders are 1. Irrecevability, 2. Judicial fee payment (500 fr), 3. No costs awarded. While Art. 66 LTF governs costs in the LTF, this decision refers to the OJ era. Since no specific cost provision from the OJ is explicitly listed in the dispositive orders (1, 2, or 3), only the procedural ground (Art. 150 al. 4 OJ) and the transitional article (Art. 132 al. 1) are strictly included.)

Considérant:
Que l'arrêt du Tribunal cantonal a été rendu le 2 novembre 2006 (séance lors de laquelle la décision a été prise), soit avant l'entrée en vigueur, au 1er janvier 2007, de la loi fédérale sur le Tribunal fédéral du 17 juin 2005 (LTF; RO 2006 p. 1242);
Qu'en vertu de l'art. 132 al. 1 de cette loi, le recours en réforme demeure soumis à la loi fédérale d'organisation judiciaire du 16 décembre 1943 (OJ);
Que la demanderesse a été invitée, le 9 mai 2007, à verser des sûretés au montant de 2'000 fr. en garantie des frais judiciaires présumés;
Que le délai disponible à cette fin était fixé au 25 mai 2007;
Que selon l'ordonnance, les conclusions présentées seraient déclarées irrecevables si le versement n'était pas accompli dans ce délai;
Que les sûretés n'ont pas été versées;
Que le recours est ainsi irrecevable conformément à cet avertissement et à l' art. 150 al. 4 OJ ;
Que l'instance n'a causé aucun frais à l'adverse partie;
