Decreto del 10 ottobre 2011
I Corte di diritto civile
Composizione
Giudice Klett, Presidente,
Cancelliere Piatti.
Partecipanti al procedimento
A.________,
patrocinato dall'avv. Giacomo Talleri,
ricorrente,
contro
B.________ SA,
patrocinata dall'avv. Fabio Soldati,
opponente.
Oggetto
responsabilità di un istituto bancario;
ricorso contro la sentenza emanata il 18 agosto 2011 dalla II Camera civile del Tribunale d'appello del
Cantone Ticino.
Considerando:
che con sentenza 18 agosto 2011 la II Camera civile del Tribunale di appello del Cantone Ticino ha respinto, in parziale accoglimento di un appello presentato dalla B.________ SA, la petizione inoltrata da A.________;
che quest'ultimo è insorto contro tale decisione con un ricorso in materia civile del 26 settembre 2011 al Tribunale federale;
che con scritto 4 ottobre 2011 il ricorrente ha dichiarato di ritirare il ricorso, chiedendo pure l'esonero dal pagamento di tasse e spese e l'annullamento del decreto 28 settembre 2011 con cui è stato invitato a fornire un anticipo per le spese presunte del processo;
che giusta l' art. 32 cpv. 1 LTF il presidente della Corte dirige il procedimento quale giudice dell'istruzione fino alla pronuncia della sentenza e che in virtù dell' art. 32 cpv. 2 LTF il giudice dell'istruzione decide quale giudice unico lo stralcio dal ruolo delle cause ritirate;
che con lo stralcio della causa il decreto del 28 settembre 2011 è divenuto caduco;
che in concreto non vengono addotti né sono ravvisabili motivi per prescindere dal prelievo delle spese giudiziarie;
che queste, comprendenti una tassa di giustizia ridotta ( art. 65 cpv. 2 LTF ), vanno quindi poste a carico del ricorrente ( art. 66 cpv. 1 LTF );
per questi motivi, la Presidente decreta:
1. La causa è stralciata dai ruoli a seguito del ritiro del ricorso.
2. Le spese giudiziarie di fr. 300.-- sono poste a carico del ricorrente.
3. Comunicazione ai patrocinatori delle parti e alla II Camera civile del Tribunale d'appello del Cantone Ticino.
