Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Tribunal declared the appellants' appeal inadmissible, upholding the lower court's eviction order against them; the appellants' request for legal aid was denied, and court costs of 300 Swiss francs were imposed on them. The dispute arose from a lease agreement that had been terminated by mutual agreement, with the tenants having committed to vacate the premises by a specified date; after they failed to do so, the landlord obtained an eviction order. The Tribunal held that the appeal failed to meet the minimum procedural requirement of providing a reasoned argument explaining how the lower court violated the law, as the appellants merely asserted unspecified factual elements and hardships without contesting the binding nature of the termination agreement. The decision was based on Article 42(2) of the Federal Act on the Federal Supreme Court (LTF), and the legal aid request was rejected for lack of any prospect of success under Article 64(1) and (3) LTF.

Sentenza del 26 settembre 2011

I Corte di diritto civile

Composizione

Giudice federale Klett, Presidente,

Cancelliere Piatti.

Partecipanti al procedimento

A.A.________ e B.A.________,

ricorrenti,

contro

C.________,

patrocinato dall'avv. Lara Toma Pelucca,

opponente.

Oggetto

espulsione,

ricorso contro la sentenza emanata il 22 agosto 2011 dalla II Camera civile del Tribunale d'appello del

Cantone Ticino.

Considerando:

che il 30 maggio 2011 C.________, nuovo proprietario dell'ente locato dai coniugi A.A.________ e B.A.________, ha sottoscritto un accordo con tali conduttori in cui questi hanno riconosciuto lo scioglimento del contratto di locazione avvenuto il 1° marzo 2011 e si sono impegnati a riconsegnare i locali entro il 30 giugno 2011;

che con decisione 29 luglio 2011 il Pretore aggiunto della Giurisdizione di Locarno-Città, adito da C.________, ha ordinato l'espulsione (sfratto) di A.A.________ e B.A.________ con la comminatoria dell' art. 292 CP ;

che il 22 agosto 2011 la II Camera civile del Tribunale di appello del Cantone Ticino ha respinto sia un appello dei soccombenti sia la loro domanda di gratuito patrocinio;

che la Corte cantonale, dopo aver sollevato dubbi sulla ricevibilità dell'appello a causa della sua carente motivazione, ha ritenuto l'impugnativa infondata, poiché il contratto di locazione era terminato e i conduttori si erano impegnati a riconsegnare i locali;

che i Giudici cantonali hanno respinto la domanda di assistenza giudiziaria per assenza di probabilità di successo dell'appello;

che A.A.________ e B.A.________ hanno impugnato la sentenza dell'ultima istanza cantonale al Tribunale federale con ricorso del 21 settembre 2011, chiedendo pure di essere posti al beneficio dell'assistenza giudiziaria;

che giusta l' art. 42 cpv. 2 LTF nella motivazione del ricorso occorre spiegare perché l'atto impugnato viola il diritto, ragione per cui il ricorrente deve confrontarsi almeno brevemente con i considerandi della sentenza impugnata, pena l'inammissibilità del gravame ( DTF 134 II 244 consid. 2.1);

che nel gravame in esame si cerca invano un'argomentazione conforme alle predette esigenze;

che infatti i ricorrenti non contestano l'esistenza del menzionato accordo né adducono un qualsiasi motivo per cui esso non dovrebbe essere vincolante, ma si limitano ad affermare l'illiceità della decisione di sfratto perché non sarebbero stati considerati non meglio specificati elementi di fatto e "gli innumerevoli disagi causati" loro dall'opponente;

che il ricorso, manifestamente non motivato in modo sufficiente, si rivela quindi inammissibile e va deciso dalla Presidente della Corte adita nella procedura semplificata ( art. 108 cpv. 1 lett. b LTF );

che in queste circostanze la domanda di assistenza giudiziaria dev'essere respinta per mancanza di possibilità di esito favorevole del ricorso ( art. 64 cpv. 1 e 3 LTF ), indipendentemente dalla pretesa indigenza dei ricorrenti;

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, la Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Le spese giudiziarie di fr. 300.-- sono poste a carico dei ricorrenti.

3. Comunicazione alle parti e alla II Camera civile del Tribunale d'appello del Cantone Ticino.

del Tribunale federale svizzero
