Failure to pay advance costs for appeal against eviction ruling
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Tribunal declared the appellant's appeal inadmissible and ordered the appellant to pay court costs of 500 Swiss francs, thereby upholding the lower court's decision on eviction. The appeal challenged a cantonal appellate court ruling in an eviction dispute, but the appellant failed to pay the required advance on costs despite a prior invitation and an extended deadline, as provided under Article 62 paragraph 3 of the Federal Supreme Court Act. Because the payment was not made within the granted timeframe, the tribunal applied the simplified procedure under Article 108 paragraph 1 letter a of the same act, rendering the appeal manifestly inadmissible without addressing the merits, and the lower court's judgment remained in force.
