Appeal Dismissed for Non-Payment of Court Costs and Insufficient Motivation
Legislator-Zusammenfassung
KI-generiertThe case involves a dispute regarding a rental agreement where one party, the defendants, were ordered by a lower court to pay damages amounting to a specific sum to the plaintiffs. Following this decision, the defendants appealed to a higher court, but their appeal was declared inadmissible due to inadequate reasoning. Subsequently, the defendants escalated the matter to the Federal Tribunal, submitting a challenge against the inadmissibility ruling. However, they failed to pay the required advance court fees by the specified deadline, and their appeal was deemed insufficiently motivated, ultimately resulting in its dismissal by the Federal Tribunal for manifest inadmissibility.

Oggetto
locazione; risarcimento danni,
ricorso contro la decisione emanata il 29 luglio 2016
dal Vicepresidente della II Camera civile del Tribunale
di appello del Cantone Ticino.
Considerando:
che il 20 aprile 2016, in accoglimento della petizione presentata da C.________ ed D.________ nei confronti di A.________ e B.________, il Pretore del distretto di Lugano ha condannato i convenuti a pagare agli attori fr. 17'569.60, oltre interessi;
che con decisione del 29 luglio 2016 il Vicepresidente della II Camera civile del Tribunale di appello del Cantone Ticino ha dichiarato irricevibile, a causa della sua carente motivazione, l'appello presentato dai convenuti;
che quest'ultimi hanno impugnato tale decisione al Tribunale federale con ricorso del 1° settembre 2016;
che con decreto 6 settembre 2016 i ricorrenti sono stati invano invitati a versare entro il 21 settembre 2016 un anticipo per le spese presunte del processo di fr. 500.--;
che il 28 settembre 2016 è stato impartito ai ricorrenti il termine suppletorio dell' art. 62 cpv. 3 LTF per effettuare il predetto pagamento entro il 13 ottobre 2016;
che il 21 ottobre 2016 la Cassa del Tribunale federale ha constatato che il richiesto anticipo non è stato pagato né accreditato sul suo conto postale e che non le è pervenuto alcun avviso di addebito di un conto bancario o postale;
che in queste circostanze il Tribunale federale non può entrare nel merito del gravame (art. 48 cpv. 4 e 62 cpv. 3 LTF);
che, a prescindere da quanto precede, l'impugnativa si appalesa pure insufficientemente motivata, i ricorrenti non spiegando, come invece richiesto dall' art. 42 cpv. 2 LTF , perché l'atto impugnato viola il diritto;
che pertanto il ricorso risulta manifestamente inammissibile e va deciso dalla Presidente della Corte adita nella procedura semplificata ( art. 108 cpv. 1 lett. a e b LTF );
che le spese giudiziarie seguono la soccombenza e sono messe a carico dei ricorrenti con vincolo di solidarietà ( art. 66 cpv. 1 e 5 LTF );
per questi motivi, la Presidente pronuncia:
1. Il ricorso è inammissibile.
2. Le spese giudiziarie di fr. 200.-- sono poste a carico dei ricorrenti in solido.
3. Comunicazione alle parti e al Vicepresidente della II Camera civile del Tribunale di appello del Cantone Ticino.
