In this case, a leasing dispute arose between two landlords and a tenant regarding overdue rent payments. The landlords, who were successful at the district court level in obtaining a judgment against the tenant for the payment of CHF 24,100 in back rent, faced an appeal from the tenant. The tenant's appeal was dismissed by the appellate court in the Canton of Ticino because it largely reiterated previous arguments without meeting the procedural requirements for appeals. Furthermore, the tenant contested the validity of the lease and the fairness of the rent, but the court found that these arguments had not been timely or properly made under the applicable legal provisions. Subsequently, the tenant challenged the appellate court's decision before the Swiss Federal Tribunal, again questioning the lease terms and seeking either the annulment of the lower court's decision or a retrial, alongside a request for legal aid. The tribunal found the appeal insufficiently substantiated and deemed it inadmissible. The request for legal aid was also denied due to the unlikely success of the appeal.

Sentenza del 25 gennaio 2024

I Corte di diritto civile

Composizione

Giudice federale Jametti, Presidente,

Cancelliere Piatti.

A.________,

Oggetto

pigioni,

Cantone Ticino (12.2023.65).

Ritenuto in fatto e considerando in diritto:
