In this case, an individual filed an appeal against an eviction order issued by the Maloja Regional Court, which was in favor of a company. The cantonal court of Grisons dismissed the individual's complaint due to lack of a signature, which was not rectified despite a request to do so, as the individual did not collect the registered letter containing this request. The individual claimed they were unable to collect the letter due to an urgent trip to Italy and requested an extension of the eviction deadline. The cantonal court treated this request as a restoration of the deadline, which was denied and forwarded it to the Swiss Federal Tribunal as a potential appeal against the previous dismissal. However, the appeal did not meet the necessary requirements and was deemed inadmissible.

Sentenza del 16 settembre 2021

I Corte di diritto civile

Composizione

Giudice federale Hohl, Presidente,

Cancelliere Piatti.

Partecipanti al procedimento

A.________,

ricorrente,

contro

B.________ SA,

patrocinata dall'avv. Michel Castelli,

opponente.

Oggetto

espulsione,

ricorso contro il decreto emanato il 3 agosto 2021

dal Tribunale cantonale dei Grigioni (ZK2 21 34).

Considerando:

che con decreto 3 agosto 2021 la II Camera civile del Tribunale cantonale dei Grigioni ha stralciato dai ruoli il reclamo presentato da A.________ per sé stesso e per C.________ contro la decisione con cui il Tribunale regionale Maloja ha accolto la domanda di sfratto presentata dalla B.________ SA;

che l'autorità cantonale ha rilevato l'assenza di firma del reclamo, vizio perdurato anche dopo l'invio di un invito a sanarlo, la relativa raccomandata non essendo stata ritirata dal destinatario nel termine di giacenza;

che con scritto non datato, ma giunto al Tribunale cantonale dei Grigioni il 2 settembre 2021, A.________ afferma di essersi dovuto recare d'urgenza in Italia, di non avere ricevuto la raccomandata e chiede " un riesame della situazione ed un'ulteriore proroga dello sfratto ";

che dopo aver trattato il predetto scritto come una domanda di restituzione del termine, respinta con decreto del 2 settembre 2021, il Tribunale cantonale dei Grigioni lo ha trasmesso al Tribunale federale in applicazione dell' art. 48 cpv. 3 LTF nell'ipotesi in cui dovesse essere considerato un ricorso contro il decreto 3 agosto 2021;

che in virtù dell' art. 42 cpv. 1 LTF i rimedi giuridici al Tribunale federale devono contenere le conclusioni e i motivi;

che giusta l' art. 42 cpv. 2 LTF nei motivi del ricorso occorre spiegare, in modo conciso e confrontandosi con i considerandi della sentenza impugnata, perché questa viola il diritto ( DTF 143 II 283 consid. 1.2.2; 140 III 86 consid. 2; 134 II 244 consid. 2.1);

che in concreto lo scritto di settembre di A.________ palesemente non soddisfa i predetti requisiti;

che pertanto il ricorso, manifestamente non motivato in modo sufficiente, si palesa inammissibile e va deciso dalla Presidente della Corte adita nella procedura semplificata ( art. 108 cpv. 1 lett. b LTF );

che viste le particolarità del caso si rinuncia a un prelievo delle spese giudiziarie (art. 66 cpv. 1 seconda frase LTF);

per questi motivi, la Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Non si prelevano spese giudiziarie.

3. Comunicazione alle parti e al Tribunale cantonale dei Grigioni.
