A company filed an appeal to the Swiss Federal Tribunal against a decision by the Cantonal Court of Appeal of Ticino, which had rejected their complaint related to an exequatur ruling. The exequatur was originally granted by the district court to enforce a decision in favor of the opposing party. During the Federal Tribunal proceedings, the appellant requested to withdraw their appeal and asked for minimal court costs and no compensation for the opposing party. On the same day, the opposing party submitted a response to the appeal and later requested the allocation of legal costs from the Federal Tribunal. Ultimately, the case was removed from the docket following the withdrawal of the appeal.

Composizione

Giudice federale Kiss, Presidente,

Cancelliere Piatti.

A.________SA,

patrocinata dagli avv.ti Jonathan Bernasconi e

patrocinata dall'avv. Jonathan Moor,

Oggetto

exequatur,

ricorso contro la sentenza emanata il 1° luglio 2019

dalla II Camera civile del Tribunale d'appello del

Cantone Ticino (12.2019.51).

Considerando:

che con sentenza 1° luglio 2019 la II Camera civile del Tribunale di appello del Cantone Ticino ha respinto, nella misura in cui era ricevibile, il reclamo presentato dalla A.________SA contro la decisione 24 gennaio 2019 con cui il Pretore del distretto di Lugano ha accolto la domanda di exequatur presentata dalla B.________;

che la A.________SA è insorta al Tribunale federale con ricorso in materia civile del 4 settembre 2019;

che con decreto 27 settembre 2019 la Presidente della Corte adita ha respinto la domanda di prestazione di garanzie per le ripetibili presentata dalla B.________;

che con scritto 18 ottobre 2019 la ricorrente ha dichiarato di ritirare il predetto ricorso e ha chiesto al Tribunale federale di limitare al minimo le spese e di rinunciare ad attribuire un'indennità per ripetibili;

che il medesimo giorno l'opponente ha inoltrato la risposta al ricorso;

che con decreto del 29 ottobre 2019 la lettera con cui è stato ritirato il ricorso è stata trasmessa all'opponente affinché potesse esprimersi per quanto attiene all'assegnazione di ripetibili;

che con scritto 4 novembre 2019 l'opponente ha chiesto l'assegnazione di ripetibili e ha prodotto la sua nota professionale per complessivi fr. 5002.80;

che tale importo non eccede i limiti previsti dalla tariffa applicabile;

che il 7 novembre 2019 l'opponente ha domandato di ricevere dal Tribunale federale in pagamento delle ripetibili " il saldo rimanente sull'anticipo spese " versato dalla ricorrente;

che giusta l' art. 32 cpv. 1 LTF il presidente della Corte dirige il procedimento quale giudice dell'istruzione fino alla pronuncia della sentenza e che in virtù dell' art. 32 cpv. 2 LTF il giudice dell'istruzione decide quale giudice unico lo stralcio dal ruolo delle cause ritirate;

che le spese giudiziarie, comprendenti una tassa di giustizia ridotta ( art. 65 cpv. 2 LTF ), e le ripetibili seguono la soccombenza e vanno pertanto poste a carico della ricorrente (art. 66 cpv. 1 e 68 cpv. 1 LTF);

che la differenza fra l'anticipo spese corrisposto e la tassa di giustizia spetta alla ricorrente, titolare della pretesa di restituzione, ragione per cui la richiesta 7 novembre 2019 va disattesa;

per questi motivi, la Presidente decreta:

Losanna, 21 novembre 2019

del Tribunale federale svizzero
