Legislator-Zusammenfassung

KI-generiert

The case involves a legal dispute over the ownership of two properties that were acquired at auction by an individual following a court ruling in favor of their claim. The original owner contested the decision, seeking both the return of the properties and damages, arguing that the appellate court's ruling was incorrect. However, the appellate court upheld the initial decision, leading the original owner to file a recourse to the federal tribunal. In their appeal, the original owner cited various legal articles but failed to adequately challenge the reasoning of the previous court judgments, resulting in the federal tribunal deeming the appeal insufficiently motivated and thus inadmissible.

Sentenza del 13 agosto 2015

I Corte di diritto civile

Composizione

Giudice federale Klett, Giudice presidente,

Cancelliere Piatti.

Partecipanti al procedimento

A.________,

ricorrente,

contro

B.B.________,

patrocinata dall'avv. Carlo Borradori,

opponente.

Oggetto

azione di rivendicazione; risarcimento danni,

ricorso contro la sentenza emanata il 16 giugno 2015 dalla I Camera civile del Tribunale d'appello del

Cantone Ticino.

Considerando:

che all'incanto del 4 dicembre 2013 C.B.________ si è aggiudicato due fondi di proprietà di A.________;

che il 5 giugno 2014 il Pretore aggiunto della giurisdizione di Locarno Campagna ha accolto l'istanza di tutela giurisdizionale nei casi manifesti inoltrata da C.B.________ e ha ordinato a A.________ di consegnare subito al nuovo proprietario i predetti fondi;

che con sentenza 16 giugno 2015, dopo aver preso atto della donazione dei due fondi a B.B.________, subentrata in causa al marito C.B.________, la I Camera civile del Tribunale di appello del Cantone Ticino ha respinto in quanto ammissibile l'appello presentato da A.________ e ha confermato il giudizio di primo grado;

che con ricorso 15 luglio 2015 A.________ invoca gli articoli 2 CC, 28 e 41 CO e chiede "pure un risarcimento (indennizzo) di fr. 70'000.--";

che giusta l' art. 42 cpv. 1 LTF i ricorsi al Tribunale federale devono contenere le conclusioni e i motivi e che in quest'ultimi occorre spiegare, in modo conciso e confrontandosi con i considerandi della sentenza impugnata ( DTF 140 III 86 consid. 2; 134 II 244 consid. 2.1), perché l'atto impugnato viola il diritto ( art. 42 cpv. 2 LTF );

che tale requisito non è soddisfatto nella fattispecie, la ricorrente limitandosi a menzionare i suddetti articoli del diritto civile e a postulare un risarcimento danni, senza però prendere in alcun modo posizione sulla sentenza cantonale;

che pertanto il ricorso, manifestamente non motivato in modo sufficiente, si rivela inammissibile e va deciso dalla Giudice presidente della Corte adita nella procedura semplificata ( art. 108 cpv. 1 lett. a LTF );

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, la Giudice presidente pronuncia:

1. Il ricorso è inammissibile.

2. Le spese giudiziarie di fr. 200.-- sono poste a carico della ricorrente.

3. Comunicazione alle parti e alla I Camera civile del Tribunale d'appello del Cantone Ticino.

Losanna, 13 agosto 2015

del Tribunale federale svizzero
