Appeal Dismissed for Failure to Pay Cost Advance
Legislator-Zusammenfassung
KI-generiertAppeal Dismissed for Failure to Pay Cost Advance The Swiss Federal Tribunal declined to entertain an appeal against a rent contract decision by the Cantonal High Court of Bern because the appellant failed to pay the required cost advance. The appellant was initially notified to pay a CHF 1,000 cost advance by February 13, 2025, and after the payment was not received, a final non-extendable deadline of March 6, 2025, was set, with the warning that failure to pay would result in the rejection of the appeal. Both judicial orders, sent to the address provided by the appellant, were returned marked "uncollected," but were deemed delivered according to Article 44(2) BGG, as the appellant was responsible for ensuring receipt of judicial notifications at the given address after filing the appeal; consequently, pursuant to Article 62(3) BGG, the appeal was dismissed, and the appellant was required to bear the court costs of CHF 500.

Gegenstand
Mietvertrag,
Beschwerde gegen den Entscheid des Obergerichts des Kantons Bern, 2. Zivilkammer, vom 8. Januar 2025
(ZK 24 463).
Erwägungen:
Art. 62 Abs. 3 BGG
auf die Beschwerde nicht einzutreten (
Art. 108 Abs. 1 lit. a BGG
).
Zivilkammer, schriftlich mitgeteilt.
