Withdrawal of Appeal Against Arbitral Award Regarding Employment Termination; Waiver of Judicial Costs
Legislator-Zusammenfassung
KI-generiertA petitioner filed an appeal with the Swiss Federal Tribunal against an arbitral award issued on November 19, 2019, by the Special Appeals Commission under Article 52 of the Collective Labor Agreement for employees of nursing homes in the Canton of Ticino. The dispute involved the termination of an employment relationship with a nursing home. However, on January 15, 2020, the petitioner decided to withdraw the appeal. Oggetto
Considerando:
che con ricorso 3 gennaio 2020 A.________ è insorta al Tribunale federale contro il lodo arbitrale emanato il 19 novembre 2019 dalla Commissione speciale di ricorso ai sensi dell'art. 52 CCL ROCA nella procedura avviata contro la Casa per anziani B.________;
che con scritto datato 15 gennaio 2020 la ricorrente dichiara di ritirare il ricorso;
che giusta l' art. 32 cpv. 1 LTF il presidente della Corte dirige il procedimento quale giudice dell'istruzione fino alla pronuncia della sentenza e che in virtù dell' art. 32 cpv. 2 LTF il giudice dell'istruzione decide quale giudice unico lo stralcio dal ruolo delle cause ritirate;
che, contrariamente a quanto sostiene la ricorrente, i giudizi del Tribunale federale concernenti controversie risultanti da un rapporto di lavoro con un valore litigioso fino a fr. 30'000.-- non sono esenti da spese giudiziarie (art. 65 cpv. 4 lett. c LTF);
che tuttavia, in caso di desistenza, il Tribunale federale può rinunciare in tutto o in parte a riscuotere spese giudiziarie ( art. 66 cpv. 2 LTF );
che in concreto, viste le particolarità del caso, si giustifica di eccezionalmente rinunciare al prelievo di spese giudiziarie;
per questi motivi, la Presidente decreta:
1. La causa è stralciata dai ruoli a seguito del ritiro del ricorso.
2. Non si prelevano spese giudiziarie.
3. Comunicazione alle parti e alla Commissione speciale di ricorso ai sensi dell'art. 52 CCL ROCA.
