Appeal Withdrawal and Judicial Costs Determination
Legislator-Zusammenfassung
KI-generiertAppeal Withdrawal and Judicial Costs Determination A litigant filed a civil appeal against a Cantonal Court decision concerning provisional debt enforcement and was ordered to pay advance court costs. The appellant subsequently withdrew their appeal, leading the Federal Court to acknowledge the withdrawal and remove the case from the register. Since the withdrawal is treated as the appellant losing the case, the ordinary rule dictates they pay judicial costs; however, given the circumstances of the case's termination and the fact that the appellee was not summoned to submit observations, the court decided not to levy judicial costs or award costs to the appellee.
