Failure to Pay Security for Costs Bars Lease Termination Appeal Review
Legislator-Zusammenfassung
KI-generiertA company disputed the termination of a contractual agreement and appealed to a higher court after their initial petition was deemed inadmissible by a lower court. The appellate court rejected their appeal, prompting the company to seek further recourse in the Federal Tribunal. However, the Federal Tribunal later found the appeal inadmissible due to the failure of the company to pay the required court fees by the specified deadline, thereby rendering the matter non-justiciable. The procedural norms dictated that judicial costs be borne by the appealing party.

A.________SA,

contro
B.________AG,
patrocinata dagli avv.ti Matteo Rossi e Dario Gabaglio,
opponente.
Oggetto
contestazione della disdetta,
ricorso contro la sentenza (12.2015.213) emanata
il 17 marzo 2017 dalla II Camera civile del Tribunale d'appello del Cantone Ticino.
Considerando:
che con sentenza 17 marzo 2017 la II Camera civile del Tribunale di appello del Cantone Ticino ha respinto l'appello presentato dalla A.________SA contro la sentenza con cui il Pretore del distretto di Lugano aveva dichiarato irricevibile la petizione inoltrata dalla predetta società nei confronti della B.________AG;
che la A.________SA è insorta al Tribunale federale con ricorso dell'8 maggio 2017;
che con decreto 11 maggio 2017 la ricorrente è stata invano invitata a versare un anticipo per le spese presunte del processo di fr. 5'000.--;
che il 20 giugno 2017 è stato impartito alla ricorrente il termine suppletorio dell' art. 62 cpv. 3 LTF per effettuare il predetto pagamento entro il 5 luglio 2017;
che il 12 luglio 2017 la Cassa del Tribunale federale ha constatato che il richiesto anticipo non è stato pagato né accreditato sul suo conto postale e che non le è pervenuto alcun avviso di addebito di un conto bancario o postale;
che in queste circostanze il Tribunale federale non può entrare nel merito del ricorso (art. 48 cpv. 4 e 62 cpv. 3 LTF);
che pertanto il ricorso si rivela manifestamente inammissibile e va deciso dalla Presidente della Corte adita nella procedura semplificata ( art. 108 cpv. 1 lett. a LTF );
che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );
per questi motivi, la Presidente pronuncia:
1. Il ricorso è inammissibile.
2. Le spese giudiziarie di fr. 500.-- sono poste a carico della ricorrente.
3. Comunicazione alle parti e alla II Camera civile del Tribunale d'appello del Cantone Ticino.
