Supreme Court Dismisses Recusal Appeal for Insufficient Specificity
Legislator-Zusammenfassung
KI-generiertIn this case, an individual requested the disqualification of a judge in the Mendrisio jurisdiction, which was initially denied by the judge of the neighboring jurisdiction. Following this, a subsequent appeal to the Cantonal Court was also dismissed. The individual further appealed to the Federal Tribunal in April 2014, asserting that the decisions violated their rights. However, the Federal Tribunal found that the appeal lacked sufficient motivation, as the individual focused primarily on alleged errors of the disqualified judge without adequately demonstrating how the appealed decisions violated legal standards. Consequently, the Federal Tribunal deemed the appeal inadmissible and rejected the request for legal assistance, attributing the costs to the individual.

Sentenza del 14 maggio 2014
I Corte di diritto civile
Composizione
Giudice federale Klett, Presidente,
Cancelliere Piatti.
Partecipanti al procedimento
A.________,
ricorrente,
contro
Pretore della Giurisdizione di Mendrisio-Sud , via Beroldingen 11, 6850 Mendrisio,
opponente.
Oggetto
ricusa,
ricorso contro la sentenza emanata il 10 marzo 2014 dalla II Camera civile del Tribunale d'appello del
Cantone Ticino.
Considerando:
che con istanza 15 ottobre 2013 A.________ ha chiesto la ricusa del Pretore della giurisdizione di Mendrisio-Sud;
che la predetta domanda è stata respinta dal Pretore della giurisdizione di Mendrisio-Nord con sentenza 29 ottobre 2013;
che il 10 marzo 2014 la II Camera civile del Tribunale di appello del Cantone Ticino ha respinto, nella misura in cui era ricevibile, un reclamo presentato da A.________;
che quest'ultima è insorta contro tale sentenza al Tribunale federale con ricorso in materia civile del 10 aprile 2014;
che il 7 maggio 2014 la ricorrente ha chiesto di essere posta al beneficio dell'assistenza giudiziaria;
che giusta l' art. 42 cpv. 2 LTF il ricorrente deve spiegare nei motivi del ricorso, in modo conciso e confrontandosi con i considerandi della sentenza impugnata ( DTF 134 II 244 consid. 2.1), perché l'atto impugnato viola il diritto;
che tale requisito non è soddisfatto nella fattispecie, poiché la ricorrente elenca nel presente gravame numerose "imprecisioni" riferite all'esame del suo reclamo e concernenti in larga misura asseriti errori imputati al Pretore ricusato, ma omette di indicare per quale motivo la sentenza impugnata, con cui il tribunale cantonale superiore ha respinto un reclamo diretto contro una decisione escludente l'esistenza di un motivo di ricusa, violerebbe il diritto;
che pertanto il ricorso, manifestamente non motivato in modo sufficiente, si appalesa inammissibile e va deciso dalla Presidente della Corte adita nella procedura semplificata ( art. 108 cpv. 1 lett. b LTF );
che in queste circostanze la domanda di assistenza giudiziaria per la sede federale dev'essere respinta per mancanza di possibilità di esito favorevole del ricorso ( art. 64 cpv. 1 e 3 LTF ), indipendentemente dall'indigenza della ricorrente;
che pertanto le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );
per questi motivi, la Presidente pronuncia:
1. Il ricorso è inammissibile.
