Inadmissibility of Appeal Lacking Adult Protection Authority Consent
Legislator-Zusammenfassung
KI-generiertThe case involves a legal dispute over an employment contract where an individual, represented by a general curator, was ordered by the Pretore of the Lugano district to pay a sum to another party. On appeal, the appellate court of Ticino reduced this amount. The individual then appealed to the Swiss Federal Tribunal in civil matters, but the appeal was deemed procedurally inadmissible due to the lack of consent from adult protection authorities required to file the appeal. This procedural defect was not rectified within the designated timeframe, leading to the simplification of the decision process and the inadmissibility of the appeal without incurring court costs.

Oggetto
contratto di lavoro,
ricorso contro la sentenza emanata il 21 marzo 2023 dalla II Camera civile del Tribunale d'appello del
Cantone Ticino (12.2022.158).
Considerando:
che con giudizio 14 ottobre 2022 il Pretore del distretto di Lugano ha, in parziale accoglimento della petizione di B.________, condannato A.________ a versare all'attrice fr. 12'438.33;
che con sentenza 21 marzo 2023 la II Camera civile del Tribunale di appello del Cantone Ticino ha, in parziale accoglimento di un appello del convenuto, ridotto il predetto importo a fr. 7'500.--;
che A.________, rappresentato dalla sua curatrice generale, è insorto al Tribunale federale con ricorso in materia civile del 17 aprile 2023;
che non è stato ordinato uno scambio di scritti;
che con decreto 18 aprile 2023, constatata l'assenza del consenso dell'autorità di protezione degli adulti ad adire il Tribunale federale ( art. 416 cpv. 1 n. 9 CC ), la curatrice generale è stata invitata a sanare il vizio entro il 3 maggio 2023;
che quest'ultima ha, con lettera 24 aprile 2023, contestato di abbisognare di tale consenso;
che il 27 aprile 2023, in risposta a tale missiva, è stato confermato il decreto del 18 aprile 2023;
che entro il termine assegnato il predetto consenso non è stato trasmesso al Tribunale federale;
che pertanto il ricorso si rivela manifestamente inammissibile e va deciso dalla Presidente della Corte adita nella procedura semplificata dell' art. 108 cpv. 1 lett. a LTF ;
che si rinuncia eccezionalmente al prelievo di spese giudiziarie ( art. 66 cpv. 1 LTF );
per questi motivi, la Presidente pronuncia:
1. Il ricorso è inammissibile.
2. Non si prelevano spese giudiziarie.
3. Comunicazione alle parti e alla II Camera civile del Tribunale d'appello del Cantone Ticino.
