Tenant Appeal Dismissed for Lack of Specificity in Challenging Admissibility Ruling
Legislator-Zusammenfassung
KI-generiertA tenant of a commercial property in Fribourg was ordered by the Vice-President of the Tribunal of Tenancy of the Sarine district to vacate and return the leased premises. The tenant appealed this decision to the II Civil Appeals Court of the Fribourg Cantonal Court, but the appeal was deemed inadmissible due to insufficient motivation according to Article 311, paragraph 1 of the Swiss Civil Procedure Code. Subsequently, the tenant brought forth a civil appeal to the Swiss Federal Tribunal seeking annulment of the prior decision. The appeal was focused on questioning whether the prior court's dismissal was incorrect, but it lacked clear arguments on how the previous court misapplied the law.

KI-generiertApplied by the Federal Tribunal to declare the appeal inadmissible (as indicated in the procedural section before the dispositive).
Cited in the reasoning as the legal basis for the inadmissibility of the appeal due to insufficient motivation, specifically concerning Article 42 al. 1 and 2 LTF.
Although not explicitly cited in the numbered dispositive orders, the ordering of court fees implies the application of cost provisions; however, since the text explicitly mentions the fee payment obligation under the reasoning context (although not in the explicit dispositive order 2), and it is standard practice, if it were explicitly cited in the dispositive it would be included. Since the dispositive only mentions the fee amount for the appellant without citing Art. 66, and only Art. 108 is cited in the final decision structure, only Art. 108 and the provisions discussed in the reasoning that directly lead to the decision are extracted according to the directive (focusing on the *final orders*).

Objet
procédure civile; motivation de l'appel
recours contre l'arrêt rendu le 11 mars 2019 par la IIe Cour d'appel civil du Tribunal cantonal du canton de Fribourg
(102 2019 46).
Considérant :
Que par décision du 10 janvier 2019, la Vice-Présidente du Tribunal des baux de l'arrondissement de la Sarine a condamné X.________ à évacuer et restituer un local commercial qui lui a été remis à bail à Fribourg;
Que la locataire condamnée a appelé de cette décision;
Que par arrêt du 11 mars 2019, la Présidente de la IIe Cour d'appel civil du Tribunal cantonal a déclaré l'appel irrecevable faute d'une motivation satisfaisant aux exigences de l' art. 311 al. 1 CPC ;
Que la locataire exerce le recours en matière civile auprès du Tribunal fédéral;
Qu'elle conclut à l'annulation de l'arrêt de la Cour d'appel;
Qu'à teneur de l' art. 42 al. 1 et 2 LTF , le recours adressé au Tribunal fédéral doit être motivé (al. 1);
Que les motifs doivent exposer succinctement en quoi la décision attaquée viole le droit (al. 2);
Que la partie recourante doit discuter les motifs de cette décision et indiquer précisément en quoi elle estime que l'autorité précédente a méconnu le droit;
Que la partie recourante peut certes se dispenser de désigner précisément les dispositions légales ou les principes non écrits tenus pour violés;
Qu'à la lecture de son exposé, il est néanmoins indispensable que l'on comprenne clairement quelles règles ont été prétendument transgressées ( ATF 140 III 86 consid. 2 p. 89);
Que ces exigences ne sont pas satisfaites en l'espèce;
Que la recourante développe diverses allégations et opinions relatives à sa relation contractuelle avec l'intimée;
Que cet exposé ne permet pas de discerner en quoi l'autorité précédente a éventuellement appliqué de manière incorrecte l' art. 311 al. 1 CPC relatif à la motivation de l'appel;
Que le recours est par conséquent irrecevable au regard de l' art. 42 al. 1 et 2 LTF ;
