Withdrawal of Appeals and Denial of Cost Exemption
Legislator-Zusammenfassung
KI-generiertWithdrawal of Appeals and Denial of Cost Exemption The appellant, challenging a cantonal court decision that upheld an eviction order, filed both a civil law appeal and a subsidiary constitutional appeal with the Federal Supreme Court. Subsequently, the appellant withdrew both appeals and requested exemption from court costs. The Federal Supreme Court, acting through its presiding judge, accepted the withdrawal and ordered the striking of the case from the docket, but rejected the request for cost exemption, imposing a reduced judicial fee of CHF 200 on the appellant based on the principle that costs follow the outcome and the case was withdrawn after expenses had been incurred.

Oggetto
espulsione,
ricorsi contro la sentenza emanata il 22 novembre 2024 dalla Camera civile dei reclami del Tribunale d'appello del Cantone Ticino (16.2024.21).
Considerando:
che con sentenza 22 novembre 2024 la Camera civile dei reclami del Tribunale di appello del Cantone Ticino ha respinto, nella misura in cui era ricevibile, il reclamo inoltrato da A.________ nei confronti della decisione con cui il Pretore del distretto di Bellinzona aveva accolto la domanda di espulsione presentata da B.________;
che A.________ ha impugnato al Tribunale federale la decisione cantonale con un ricorso in materia civile e un ricorso sussidiario in materia costituzionale del 13 gennaio 2025;
che non è stato ordinato uno scambio di scritti;
che con lettera 17 febbraio 2025 il ricorrente ha dichiarato di ritirare i predetti ricorsi e ha chiesto di essere esentato dal pagamento di spese giudiziarie;
che giusta l'
art. 32 cpv. 1 LTF
il presidente della Corte dirige il procedimento quale giudice dell'istruzione fino alla pronuncia della sentenza e che in virtù dell'
art. 32 cpv. 2 LTF
il giudice dell'istruzione decide quale giudice unico lo stralcio dal ruolo delle cause ritirate;
che in concreto non vi è motivo di prescindere dal prelievo di spese giudiziarie;
che queste, comprendenti però una tassa di giustizia ridotta (
art. 65 cpv. 2 LTF
), seguono la soccombenza e vanno pertanto poste a carico del ricorrente (
art. 66 cpv. 1 LTF
);
per questi motivi, il Presidente decreta:
