In this case, a company terminated both the employment contract and corporate mandate of an employee without prior notice on March 6, 2015. The former employee filed a lawsuit seeking compensation for salaries, damages for unjust dismissal, and various participations totaling CHF 436,966.65. The District Court of Lugano dismissed the petition on June 12, 2017. However, upon appeal, the Second Civil Chamber of the Appellate Court of the Canton of Ticino found a violation of the right to be heard and annulled the initial ruling, remanding the case back to the first instance court. The appellant company then filed a civil law appeal with the Swiss Federal Tribunal on January 14, 2019, challenging the appellate court's partial acceptance of the former employee’s appeal and seeking to uphold the original decision.

Sentenza del 25 gennaio 2019

I Corte di diritto civile

Composizione

Giudice federale Kiss, Presidente,

Cancelliere Piatti.

Partecipanti al procedimento

A.________AG,

patrocinata dall'avv. Emanuele Verda,

ricorrente,

contro

B.________,

patrocinato dalle avv.te Maria Galliani e Valentina Zeli,

Oggetto

risoluzione immediata del rapporto di lavoro,

ricorso contro la sentenza emanata il 26 novembre 2018 dalla II Camera civile del Tribunale d'appello del

Cantone Ticino (12.2017.110).

Considerando:

che il 6 marzo 2015 la A.________AG ha rescisso con effetto immediato sia il contratto di lavoro sia il mandato societario con B.________, assunto nel 2011;

che il Pretore del distretto di Lugano ha respinto, con sentenza 12 giugno 2017, la petizione con cui B.________ ha chiesto di condannare la sua ex datrice di lavoro a pagargli fr. 436'966.65 a titolo di salario, di indennità per licenziamento ingiustificato e di varie partecipazioni;

che con sentenza 26 novembre 2018, riscontrata una violazione del diritto di essere sentito, la II Camera civile del Tribunale di appello del Cantone Ticino ha, in parziale accoglimento di un appello presentato dal lavoratore, annullato la sentenza pretorile e ha rinviato gli atti di causa al giudice di prima istanza per continuazione della procedura nel senso dei considerandi;

che con ricorso in materia civile del 14 gennaio 2019 la A.________AG chiede al Tribunale federale di, in riforma della sentenza cantonale, respingere l'appello;

che non è stato ordinato uno scambio di scritti;

che la decisione impugnata è una decisione incidentale nel senso dell' art. 93 cpv. 1 LTF ( DTF 140 V 321 consid. 3.1) unicamente suscettiva di un ricorso in materia civile se può causare un danno irreparabile di natura giuridica ( art. 93 cpv. 1 lett. a LTF ) o se l'accoglimento del ricorso comporterebbe una decisione finale consentendo di evitare una procedura probatoria defatigante o dispendiosa ( art. 93 cpv. 1 lett. b LTF );

che spetta al ricorrente spiegare perché sono date le condizioni di cui all' art. 93 LTF , fatti salvi i casi in cui queste risultano in modo manifesto dalla decisione impugnata o dalla natura della causa ( DTF 138 III 46 consid. 1.2);

che nella fattispecie il sussistere dei presupposti previsti dalla predetta norma per un ricorso immediato al Tribunale federale non è ravvisabile (segnatamente nulla si sa sul dispendio provocato dal sentire i 4 testi per la cui audizione la causa è stata rinviata al giudice di primo grado) né la ricorrente, limitandosi a trascrivere il testo dell' art. 93 cpv. 1 lett. b LTF , spende una parola per illustrarne l'esistenza;

che in tali circostanze il ricorso si rivela manifestamente inammissibile e va deciso dalla Presidente della Corte adita nella procedura semplificata ( art. 108 cpv. 1 lett. a LTF );

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, la Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Le spese giudiziarie di fr. 500.-- sono poste a carico della ricorrente.

3. Comunicazione ai patrocinatori delle parti e alla II Camera civile del Tribunale d'appello del Cantone Ticino.
