Legislator-Zusammenfassung

KI-generiert

The case involves an independent worker who had taken out an insurance policy for loss of earnings due to illness and injury. The insurance company denied his claim for daily allowances requested in June 2013, arguing that the right to benefits was prescribed and that the incapacitation arose from an injury occurring before the policy was active due to the insured's failure to pay premiums. The first-instance court supported the insurance company’s decision, asserting that the incapacity to work was not covered under the circumstances. The insured then appealed against this decision, claiming he had paid his premiums and contested the prescription of his claims. However, the court found the appeal to be insufficiently motivated and, therefore, inadmissible.

Sentenza del 26 maggio 2014

I Corte di diritto civile

Composizione

Giudice federale Klett, Presidente,

Cancelliere Piatti.

Partecipanti al procedimento

A.________,

ricorrente,

contro

B.________ SA,

opponente.

Oggetto

Ritenuto in fatto e considerando in diritto:

3.4; 138 I 97 consid. 4.1.4; 133 IV 119 consid. 6.3).
