Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Supreme Court declared the appellant's subsidiary constitutional appeal inadmissible and struck it from the record, upholding the Federal Administrative Court's decision that had rejected the appeal against the Federal Migration Office's order extending a cantonal removal (renvoi) measure to the entire Swiss territory. The appellant had sought annulment and remand for a new decision, but the Court found the appeal inadmissible because the challenged decision was not subject to a public law appeal and, decisively, the Federal Supreme Court only hears constitutional appeals against decisions of final cantonal authorities (Art. 113 LTF), not those from the Federal Administrative Court; consequently, court costs of 500 Swiss francs were imposed on the appellant's counsel for causing unnecessary expenses (Art. 66 al. 3 LTF).

IIe Cour de droit public

Composition

M. le Juge Müller, Président.

Greffière: Mme Charif Feller.

Parties

X.________, représenté par Me Yves H. Rausis, avocat, recourant,

contre

Office fédéral des migrations, 3003 Berne.

Objet

Renvoi,
