Withdrawal of Constitutional Appeal Against Residence Permit Refusal and Exceptional Cost Waiver
Legislator-Zusammenfassung
KI-generiertThe case involves an individual, referred to as the appellant, who filed an appeal against a decision concerning the denial of the renewal of their residence permit by the Administrative Court of the Canton of Ticino. The appeal was directed against the judgment given on June 7, 2021. The appellant later decided to withdraw the appeal, leading to the termination of the proceedings before the Swiss Federal Tribunal. Consequently, the court did not process any judicial fees or assign compensations for the federal stage, and the assistance request made by the appellant concerning judicial fees was deemed moot. Notifications of the withdrawal and termination were sent to the relevant parties, including the population section of the Department of Institutions of the Canton of Ticino, the State Council, and the State Secretariat for Migration.

visto:
il ricorso sussidiario in materia costituzionale presentato l'8 luglio 2021 da A.________ contro la sentenza emanata il 7 giugno 2021 dal Tribunale amministrativo del Cantone Ticino in materia di rifiuto del rinnovo del permesso di dimora;
la lettera del 16 agosto 2021 con cui il ricorrente ha dichiarato di ritirare il ricorso;
considerando:
che, quando il ricorso è ritirato, il Presidente della Corte adita ( art. 32 cpv. 1 e 2 LTF ) dichiara il processo terminato nonché statuisce sulle spese giudiziarie e sull'assegnazione e l'ammontare delle ripetibili (art. 5 cpv. 2 e 73 cpv. 1 PC combinati con l' art. 71 LTF );
che, di riflesso, viene annullato il termine con scadenza al 14 settembre 2021 fissato alle autorità cantonali per presentare eventuali osservazioni;
che, sebbene, in caso di desistenza, le spese giudiziarie debbono essere poste, in linea di principio, a carico della parte ricorrente con l'applicazione di una tassa di giustizia ridotta ( art. 66 cpv. 2 LTF ), si giustifica nella fattispecie, considerate le circostanze particolari del caso, di rinunciare a riscuoterle;
che ciò rende priva d'oggetto la domanda di assistenza giudiziaria contenuta nel gravame, limitata all'esonero delle spese giudiziarie;
che non si assegnano ripetibili ad autorità vincenti ( art. 68 cpv. 3 LTF );
per questi motivi, il Presidente decreta:
