Legislator-Zusammenfassung

KI-generiert

The case involves an individual who sought to challenge the refusal of the cantonal office responsible for population affairs in Geneva to renew their residence permit for study purposes. Initially denied on February 28, 2008, the individual appealed the decision, but later withdrew their appeal, leading to a decision by the Commission for Appeals in Foreign Police on September 23, 2008. Subsequently, the individual filed a constitutional appeal to the Federal Tribunal, requesting the annulment of the September 23 decision and a remand of the issue to the cantonal court of Neuchâtel. However, the Federal Tribunal found the appeal manifestly inadmissible due to lack of proper motivation and because the contested decision did not originate from a final authority of the relevant canton. The case was processed under simplified procedures, and the individual was ordered to bear the judicial costs.

Arrêt du 16 janvier 2009

IIe Cour de droit public

Composition

M. le Juge Merkli, Juge présidant.

Greffière: Mme Charif Feller.

Parties

X.________, recourante,

contre
