In this case, an individual challenged decisions by a communications office requiring payment of broadcast reception fees for several periods between 2012 and 2016. After the office rejected the individual's appeals against these decisions, the individual sought relief from a federal administrative court, which mandated an advance payment to cover potential legal costs. The individual subsequently filed a public law appeal with the federal tribunal requesting exemption from this advance payment due to financial hardship. The tribunal determined that the matter should be treated as a request for a reduction or exemption of the advance payment and decided to refer it back to the administrative court for further handling.

Art. 30 cpv. 2 LTF

The appeal was referred to the lower court for treatment as a request for exemption/reduction of the cost advance, based on the explicit citation in the reasoning section referring to this article as the basis for referral due to lack of competence/nature of the request.

Art. 32 cpv. 2 combinato con il cpv. 1 LTF

Cited as the procedural basis for striking the case from the roll because it was referred to another authority.

Art. 66 cpv. 1 seconda frase LTF

Cited in the dispositive as the basis for not levying judicial costs.

Sentenza dell'8 novembre 2017

II Corte di diritto pubblico

Composizione

Giudice federale Seiler, Presidente,

Cancelliera Ieronimo Perroud.

Partecipanti al procedimento

A.________,

ricorrente,

contro

B.________SA,

Ufficio federale delle comunicazioni (UFCOM), casella postale, 2501 Bienna.

Oggetto

Canone di ricezione radiotelevisivo (anticipo delle

spese processuali),

Ritenuto in fatto e considerando in diritto:
