Communes' Subsidy Appeal Struck Due to Lack of Standing in Prior Ruling
Legislator-Zusammenfassung
KI-generiertTwo Swiss municipalities filed an administrative appeal with the Cantonal Tribunal of Vaud and a public law and constitutional appeal with the Federal Tribunal. They challenged a decision by the Vaud State Council, which rejected their request for a subsidy of 22 million francs for constructing a regionally important road. The Federal Tribunal case, identified as 2C_896/2019, was initially suspended pending the outcome of the cantonal appeal. The Cantonal Tribunal dismissed the administrative appeal due to the municipalities' lack of standing. Consequently, the Federal Tribunal inquired about the continuation of case 2C_896/2019, leading the municipalities to acknowledge that their federal appeals were now moot. The Vaud State Council deferred to the judgment of the courts, resulting in the appeal being formally dismissed without costs or damages.

KI-generiertCited implicitly by ordering that no court fees shall be charged (no fees are to be charged).
This provision is implicitly used as the basis for striking the case from the roll because it became moot (though it is not explicitly cited in the dispositive, in common practice for rendering procedural matters in interlocutory orders where the main issue is moot, the procedural basis is often assumed, however strictly following the rule: since no article is explicitly cited in order 1 or 2 other than dealing with costs, and order 1 states the matter is moot, the output will only contain cost provisions).
