Study A v. Federal Administrative Court (Value Added Tax Appeal Withdrawal)
Legislator-Zusammenfassung
KI-generiertThe case involves a taxpayer appealing against a value-added tax decision made by the Federal Administrative Court. Following that ruling on December 15, 2011, the taxpayer sent a letter to the Federal Administrative Court expressing uncertainty about their intention to pursue further legal action. In response, the Federal Administrative Court forwarded the taxpayer's correspondence to the Federal Tribunal to protect their potential appeal rights. The Federal Tribunal then requested clarification from the taxpayer regarding their intent to appeal and the necessary documentation. Ultimately, the taxpayer indicated on February 6, 2012, that they did not wish to proceed with an appeal, leading to the case being removed from the Tribunal's agenda without any costs or awards.

Partecipanti al procedimento
Studio A.________,
ricorrente,
contro
Amministrazione federale delle contribuzioni, Eigerstrasse 65, 3003 Berna.
Oggetto
Imposta sul valore aggiunto,
ricorso contro la sentenza emanata il 15 dicembre 2011 dal Tribunale amministrativo federale, Corte I.
Considerando:
che il 27 gennaio 2012 il Tribunale amministrativo federale ha trasmesso al Tribunale federale la lettera inviatagli il 24 gennaio precedente dallo Studio A.________ a seguito della sua decisione del 15 dicembre 2011 in materia d'imposta sul valore aggiunto;
che tale trasmissione è stata effettuata al fine di preservare eventuali diritti ricorsuali del contribuente dato che, a parere del Tribunale amministrativo federale, dalla lettera del 24 gennaio 2012 non risultavano in modo chiaro le sue intenzioni al riguardo;
che con decreto del 31 gennaio 2012 il Tribunale federale ha invitato lo Studio A.________ a comunicargli entro il 10 febbraio 2012 se voleva ricorrere o no nonché, nel caso in cui era sua intenzione adire questa Corte, a completare il proprio gravame, pena la sua inammissibilità per difetto di motivazione ( art. 42 LTF );
che con lettera del 6 febbraio 2012 lo Studio A.________ ha comunicato al Tribunale federale che non intendeva interporre ricorso contro la decisione del Tribunale amministrativo federale;
che, in queste condizioni, la presente causa va stralciata dai ruoli;
che non si prelevano spese ( art. 66 cpv. 1 LTF ) né si assegnano ripetibili ( art. 68 cpv. 3 LTF );
per questi motivi, il Presidente decreta:
1. La causa 2C_86/2012 è stralciata dai ruoli.
2. Non si prelevano spese né si concedono ripetibili.
3. Comunicazione allo Studio A.________, all'Amministrazione federale delle contribuzioni e al Tribunale amministrativo federale, Corte I.
