Legislator-Zusammenfassung

KI-generiert

The case involves an individual who appealed to the Swiss Federal Tribunal after the Administrative Tribunal of the Canton of Ticino rejected their appeal regarding the revocation of their residence permit. The appeal to the Federal Tribunal was filed following the September 21, 2020 decision of the Cantonal Administrative Tribunal. However, the Federal Tribunal found that the appeal did not adequately address the legal arguments provided in the prior judgment, nor did it validly contest the facts established in that decision, rendering the appeal insufficiently motivated. Consequently, the appeal was declared inadmissible, although no procedural costs were charged.

Sentenza del 23 ottobre 2020

II Corte di diritto pubblico

Composizione

Giudice federale Seiler, Presidente,

Cancelliere Savoldelli.

Partecipanti al procedimento

A.________,

ricorrente,

contro

Sezione della popolazione,

Dipartimento delle istituzioni del Cantone Ticino,

Residenza governativa, 6500 Bellinzona,

Consiglio di Stato del Cantone Ticino,

Residenza governativa, 6500 Bellinzona.

Oggetto

Permesso di dimora,

ricorso contro la sentenza emanata il 21 settembre 2020 dal Tribunale amministrativo del Cantone Ticino (52.2019.270).

Visto:

che, con sentenza del 21 settembre 2020, Il Tribunale amministrativo del Cantone Ticino ha respinto un ricorso interposto da A.________ in relazione alla revoca del suo permesso di dimora;

che, con atto del 18/20 ottobre 2020, A.________ ha impugnato detto giudizio davanti al Tribunale federale;

considerando:

che il Tribunale federale esamina d'ufficio l'ammissibilità dei gravami che gli vengono sottoposti ( DTF 136 II 497 consid. 3 pag. 499);

che, secondo l' art. 42 cpv. 2 LTF , il ricorso deve spiegare in modo conciso perché l'atto impugnato viola il diritto e deve pertanto confrontarsi - almeno brevemente - con le argomentazioni contenute nello stesso ( DTF 134 II 244 consid. 2.1 pag. 245 seg.);

che, giusta l' art. 106 cpv. 2 LTF , esigenze più severe valgono inoltre in relazione alla violazione di diritti fondamentali ( DTF 134 II 244 consid. 2.2 pag. 246);

che, d'altra parte, il Tribunale federale può scostarsi dall'accertamento dei fatti solo se è stato eseguito in violazione del diritto o in modo manifestamente inesatto, cioè arbitrario ( art. 105 cpv. 1 e 2 LTF );

che il gravame del 18/20 ottobre 2020 non si confronta affatto con le argomentazioni giuridiche contenute nel giudizio impugnato e nemmeno contesta (validamente) l'accertamento dei fatti;

che lo stesso risulta pertanto motivato in maniera manifestamente insufficiente e dev'essere dichiarato inammissibile sulla base della procedura semplificata prevista dall' art. 108 cpv. 1 lett. b LTF ;

che, tenuto conto delle circostanze, il Tribunale federale rinuncia tuttavia a prelevare spese (art. 66 cpv. 1 seconda frase LTF);

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile

2. Non vengono prelevate spese.

3. Comunicazione al ricorrente, alla Sezione della popolazione del Dipartimento delle istituzioni, al Consiglio di Stato e al Tribunale amministrativo del Cantone Ticino, nonché alla Segreteria di Stato della migrazione.
