The case involves a public law appeal from an individual previously detained in connection with immigration issues, specifically regarding their detention in view of expulsion. The appeal was directed against a decision made by a single judge of the cantonal court of Valais. As of December 9, 2009, the individual was notified of their departure to Istanbul, which rendered the appeal moot. Consequently, the Federal Tribunal concluded that the case was no longer relevant, resulting in its removal from the court docket. Additionally, the court granted legal assistance to the individual, acknowledging the fulfillment of the necessary conditions for such support.

Art. 32 al. 1 et 2 LTF

Cited in the reasoning as the President's legal basis for striking the case from the roll when it becomes moot (though Art. 71 LTF/Art. 72 PCF relate to the costs aspect of the moot case).

Art. 64 al. 1 LTF

Cited implicitly in the reasoning to justify that the appeal itself was not manifestly unfounded, which affects the assessment of costs/legal aid, although not explicitly repeated in the final orders, but its companion articles related to legal aid are cited.

Art. 64 al. 3 3e phrase LTF

Cited in the reasoning as the basis for the President's authority to grant full legal aid when conditions are clearly met.

Art. 64 al. 2 LTF

Cited in the reasoning to establish justification for granting an attorney for the appeal.

Art. 66 al. 1 LTF

This article is not explicitly cited in the final orders (dispositive 1-5) despite ruling on costs (Order 3: 'Il n'est pas perçu de frais judiciaires'). Upon re-checking, only the ruling about the exemption of judicial fees is present, which implies an application of cost allocation rules, but the citation for costs (Art. 66 LTF) is absent from the dispositive.

Art. 71 LTF

Cited by reference in the reasoning to use Art. 72 PCF for costs in the context of federal law procedures.

Art. 72 PCF

Cited in the reasoning as the basis for determining the fate of costs when the case becomes moot.

Ordonnance du 25 janvier 2010

IIe Cour de droit public

Composition

Le Juge fédéral Müller, Président.

Greffière: Mme Charif Feller.

Parties

X.________,

représenté par Me Michel De Palma, avocat,

recourant,

contre
