The Swiss Federal Supreme Court declared the appellant's public-law appeal inadmissible and imposed court costs of CHF 300 on the appellant, who thus did not prevail. The appeal challenged a lower court decision (Tribunal administratif du Canton Ticino, June 26, 2012) that upheld the revocation of the appellant's residence permit (permesso di domicilio) by the cantonal authorities. The Court based its decision on procedural grounds: the appellant failed to pay the required advance on costs (CHF 1,500) or provide evidence of indigence within the extended, non-extendable deadline (September 24, 2012), despite being invited to do so. Under Articles 62(1), 62(3), and 63(3) of the Federal Supreme Court Act (LTF), non-payment of the advance even after a supplementary deadline leads to dismissal of the appeal. The Court applied the simplified procedure of Article 108(1)(a) LTF and ordered the appellant to bear the unnecessary costs under Article 66(3) LTF.

Sentenza dell'8 ottobre 2012

II Corte di diritto pubblico

Composizione

Giudice federale Zünd, Presidente,

Cancelliera Ieronimo Perroud.

Partecipanti al procedimento

A.________,

ricorrente,

contro

Ritenuto in fatto e considerando in diritto:

che il 27 luglio 2012 A.________ ha esperito dinanzi al Tribunale federale un ricorso in materia di diritto pubblico, con domanda di assistenza giudiziaria, contro la pronuncia 26 giugno 2012 del Tribunale amministrativo del Cantone Ticino, relativa alla revoca del permesso di domicilio;

che con decreto del 3 agosto 2012 il ricorrente è stato invitato a fornire, entro il 5 settembre 2012, un anticipo delle spese di fr. 1'500.-- oppure a fornire ogni documento atto a provare la propria indigenza;

che la parte che adisce il Tribunale federale deve versare un anticipo equivalente alle spese giudiziarie presunte (art. 62 cpv. 1 prima frase LTF);

che il giudice dell'istruzione stabilisce un congruo termine per il versamento dell'anticipo e se il termine scade infruttuoso, impartisce un termine suppletorio (art. 62 cpv. 3 prima e seconda frase LTF);

che se l'anticipo non è versato nemmeno nel termine suppletorio, il Tribunale federale non entra nel merito dell'istanza (art. 63 cpv. 3 terza frase LTF);

che nel caso concreto nel termine suppletorio e non prorogabile fissato al 24 settembre 2012 non è stato fornito l'anticipo spese richiesto né sono stati inviati i documenti atti a provare l'indigenza dell'interessato, motivo per cui il presente ricorso non può essere trattato nel merito;

che, statuendo secondo la procedura semplificata di cui all' art. 108 cpv. 1 lett. a LTF , il ricorso dev'essere di conseguenza dichiarato irricevibile conformemente a quanto previsto dall' art. 62 cpv. 3 LTF ,

che, infine, le spese inutili sono sostenute dal ricorrente, che le ha cagionate ( art. 66 cpv. 3 LTF );

per questi motivi il Presidente pronuncia:

1. Il ricorso è inammissibile.
