Legislator-Zusammenfassung

The case involves a dispute regarding study grants in which a party challenged a decision made by the Service des bourses et prêts d'études in Geneva. The Geneva Court of Justice had previously ruled in favor of the individual, prompting the Service to appeal to the Swiss Federal Tribunal. The appeal was submitted under public law and constitutional grounds; however, the Tribunal found the appeal to be inadmissible due to a lack of proper representation by the Service, which failed to demonstrate its authority to act on behalf of the canton in this matter. Thus, the Tribunal confirmed the lower court's decision and required the appealing party to bear the costs of the procedure.

A.________,

intimée.

Objet
