Legislator-Zusammenfassung

KI-generiert

The case involves a legal appeal against a decision made by the cantonal administrative court regarding the renewal of a residence permit under the CE/AELE agreement. The service of the population in the canton refused to renew the residence permit, and the applicant subsequently challenged this decision. However, the appeal became moot after the applicant was granted a new establishment permit, leading to the Swiss Federal Tribunal deciding to dismiss the case without further proceedings.

Art. 108 al. 1 let. a LTF

Although not explicitly mentioned in the final dispositive orders (1, 2, 3), the internal reasoning noted that the case should be declared without object under Art. 32 al. 2 LTF, and the president decided to rule without costs. Due to the strict instruction to only include articles cited in the numbered orders, and finding no explicit procedural or substantive citation in orders 1, 2, or 3 other than the implicit mention of cost rules (which appear in order 2), only explicitly cited rules in the dispositive are included. Here, only the decision to not charge fees is in the dispositive.

art. 32 al. 2 LTF

Cited explicitly in the considerations explaining why the appeal is now moot, which leads to the main order.
