Death of Appellant Renders Residence Permit Revocation Appeal Moot
Legislator-Zusammenfassung
KI-generiertThe case involves an individual who filed a public law appeal against a decision made by the administrative court of a canton regarding the revocation of their residence permit. The appeal was submitted after the individual’s residence authorization was annulled, and coincided with a request for legal aid. However, the situation changed due to the individual's death before the appeal could be settled, leading the court to determine that the case was no longer relevant and subsequently dismiss it. The court also approved legal assistance and appointed a defense attorney, along with awarding compensation for their services.

KI-generiertUsed to declare the appeal moot because the underlying issue became without object due to the death of the appellant.
Used to grant the request for legal aid and appoint an official defense counsel.
Although costs are not explicitly mentioned in the operative text, article 66 (costs) is often implicitly coupled with Art. 64 (legal aid) or is the basis for the decision not to charge court fees (Art. 4 and 66 LTF govern costs; Art. 64 establishes the procedure when legal aid is granted, which includes the waiver/payment of fees). However, since the text explicitly states in the dispositive 'Il n'est pas perçu de frais de justice' (No court fees are charged), and the reasoning mentions 'art. 64 LTF' which covers legal aid but not explicitly fees, and there is no explicit mention of Art. 66 in the dispositive, I will strictly adhere to the explicit mentions in the numbered orders. The explicit orders cite Art. 32 and Art. 64 in the 'Vu' section, and the operative text orders the waiver of fees (Order 4), but does not cite the legal basis for Order 4 or Order 3 (indemnification) in the operative section itself, only the basis for mootness and legal aid in the preceding 'Vu' section. Based strictly on the explicit citation in the numbered orders (1-5), only Art. 32 and Art. 64 are cited as the legal basis for the procedural steps taken.
