Asylum seeker's appeal against denial-of-justice ruling on reconsideration of non-entry decision; inadmissible under Article 83 LTF exclusion for asylum and removal matters.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court declared the appellants' appeal inadmissible, upholding the Federal Administrative Court's dismissal of their complaint for denial of justice. The appellants had sought to compel the State Secretariat for Migration to rule on their request for reconsideration of a 2014 decision not to enter into their asylum application, also invoking the 1980 European Agreement on transfer of responsibility for refugees and requesting suspensive effect on their removal. The Court held that appeals in asylum and removal matters are categorically excluded under Article 83 letters c and d of the Federal Supreme Court Act, which also bars challenges to reconsideration requests and complaints alleging denial of justice. No court fees were imposed.

Objet
Déni de justice; retard injustifié,
recours contre l'arrêt du Tribunal administratif fédéral, Cour V, du 14 mars 2017.
Considérant en fait et en droit :
