An Algerian national, referred to as A.________, appealed to the Swiss Federal Tribunal after the Federal Administrative Court rejected his request for legal assistance in challenging a decision that imposed a seven-year entry ban on him from Switzerland, as issued by the State Secretariat for Migration on May 17, 2019. The Federal Administrative Court had denied his reconsideration for legal assistance on January 30, 2020, due to the perceived low success probability of his appeal. Consequently, A.________ sought a judicial review, claiming the denial violated his constitutional rights under Article 29 paragraph 3 of the Swiss Constitution, which pertains to legal assistance for those in need. However, his appeal to the Federal Tribunal was deemed inadmissible as it addressed an immigration ban, a matter not generally reviewable by the court under public law recourse.

Arrêt du 17 février 2020

IIe Cour de droit public

Composition

M. le Juge fédéral Seiler, Président.

Greffier : M. Dubey.

A.________,

recourant,

Secrétariat d'Etat aux migrations,

intimé.

Objet

113 LTF a contrario).
