Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Supreme Court declared the appellant's public-law appeal inadmissible, upholding the cantonal administrative court's decision that refused renewal of the appellant's residence permit and ordered expulsion from Switzerland. The appellant, whose permit renewal was denied by the cantonal population and migration service, filed a brief merely stating disagreement with the ruling and announcing a new relationship with a Swiss national whom he wished to marry, without presenting any legal argument. The Court held that the appeal failed to meet statutory requirements under Article 42(2) of the Federal Supreme Court Act (exposing succinctly how the challenged act violates the law) and that the newly alleged relationship was inadmissible new fact under Article 99 of the same Act, which bars new facts or evidence not arising from the prior decision. Costs of 500 Swiss francs were imposed on the appellant, with no compensation awarded.

Arrêt du 15 janvier 2016

IIe Cour de droit public

Composition

M. le Juge fédéral Zünd, Président.

Greffier : M. Dubey.

Participants à la procédure

X.________, recourant,

contre
