Legislator-Zusammenfassung

KI-generiert

In this case, an individual, who is an intern lawyer in Lausanne, filed a request for legal aid before the national court after their application was rejected by the cantonal court. The applicant reported a gross monthly income of 2,500 francs, but after deducting living expenses, including rent and social insurance, they effectively had a disposable income of 1,380 francs. The court found that this amount exceeded the minimum vital threshold for a single person, concluding that the applicant was not in need of assistance as defined by legal standards, thus leading to the rejection of the request for legal aid.

Vu:

la demande d'assistance judiciaire présentée par le recourant;

Considérant:

Que le recourant, avocat-stagiaire à Lausanne, perçoit un revenu mensuel brut de 2'500 fr.;

Qu'il dispose effectivement d'un montant mensuel de 1380 fr., après déduction de ses charges de loyer (980 fr. pour un appartement et une place de stationnement) et d'assurances sociales (140 fr., l'assurance-maladie étant couverte par le subside cantonal);

Que le minimum vital (1'100 fr. pour une personne seule) est ainsi nettement dépassé;

Que le recourant ne se trouve donc pas dans le besoin au sens de l' art. 152 OJ ;

Que la demande d'assistance judiciaire doit ainsi être rejetée, l'une des conditions fixées par cette disposition n'étant pas satisfaite;

Par ces motifs, le Tribunal fédéral prononce:

1. La demande d'assistance judiciaire est rejetée.
