In this case, an ongoing criminal investigation involves an individual accused of serious drug-related offenses. The investigation’s procedural documents were recorded in French, and the accused requested translations of these documents into Spanish, which was denied by the investigating judge. Following this denial, the accused appealed to the Cantonal Court, which upheld the original decision. The accused subsequently filed a public law appeal with the Swiss Federal Tribunal, seeking to overturn the Cantonal Court's ruling. However, the court deemed the appeal inadmissible, as the decision in question was deemed incidental and did not result in irreparable harm. The case also included a request for legal aid, which was denied due to the lack of success potential in the appeal.

Although the text uses 'OJ' (the old law, Organisation de la justice), in the context of imposing court fees, the modern equivalent structure is reflected in the ordering part, which dictates the payment of judicial fees (Art. 66 al. 1 LTF in the new law, corresponding to the general imposition of costs derived from the procedural decision under the old law). Based strictly on the text provided, the relevant procedural article establishing the court's authority to impose costs is implied/preceded by Art. 36a OJ, and the specific imposition is Art. 1'000 fr., which falls under the general cost ruling that, under the procedural framework used, necessitates citing the relevant cost provision (Art. 66 al. 1 LTF for court fees in the new system, or the applicable cost article under OJ).

Arrêt du 14 février 2002

Ire Cour de droit public

Les juges fédéraux Aemisegger, président de la Cour et vice-président du Tribunal fédéral,

Aeschlimann, Reeb,

greffier Thélin.

H.________, recourant, représenté par Me Philippe Richard, avocat, Petit-Chêne 18, case postale 2593, 1002 Lausanne,

contre

Qu'une enquête pénale est actuellement en cours contre H.________, prévenu d'infraction grave à la législation sur les stupéfiants;

Que les procès-verbaux d'auditions sont établis en français;

Que le prévenu a demandé leur traduction dans sa propre langue, soit en espagnol;

Que cette requête a été rejetée par le Juge d'instruction chargé de l'enquête, puis, sur recours du prévenu, par le Tribunal d'accusation du Tribunal cantonal du canton de Vaud;

Que cette juridiction a statué le 8 janvier 2002;

Que H.________ a saisi le Tribunal fédéral d'un recours de droit public tendant à l'annulation de ce dernier prononcé;

Que selon l' art. 87 al. 2 OJ , le recours de droit public est recevable contre des décisions préjudicielles ou incidentes seulement s'il peut en résulter un préjudice irréparable;

Que cette disposition, dans sa teneur en vigueur depuis le 1er mars 2000, est applicable quels que soient les droits constitutionnels en cause;

Que la décision prise au cours de l'instruction d'une cause pénale, ayant pour objet de refuser la traduction de documents, est une simple étape du procès pénal et constitue donc une décision incidente aux termes de l' art. 87 al. 2 OJ ( ATF 123 I 325 consid. 3b p. 327, 122 I 39 consid. 1 p. 41);

Que cette décision n'entraîne, pour le prévenu, aucun préjudice juridique qu'un prononcé final favorable, tel qu'un jugement d'acquittement, ne supprimerait pas entièrement;

Que le grief tiré du refus de traduire des documents pourra être soulevé efficacement, le cas échéant, contre un éventuel jugement de condamnation;

Que la décision n'entraîne donc pas de préjudice irréparable;

Que de ce point de vue, la situation juridique est différente de celle créée par un prononcé ayant pour objet de fixer la langue de la procédure (cf. arrêt 1P.500/2001 du 11 octobre 2001, consid. 1a);

Que le recours est ainsi irrecevable au regard de la disposition précitée;

Que son auteur a présenté une demande d'assistance judiciaire;

Que selon l' art. 152 OJ , le Tribunal fédéral peut accorder l'assistance judiciaire à une partie à condition que celle-ci soit dans le besoin et que ses conclusions ne paraissent pas d'emblée vouées à l'échec;

Que le recourant paraît dépourvu de ressources;

Qu'en revanche, la procédure entreprise devant le Tribunal fédéral était dépourvue de chances de succès;
