The case involves an individual who, after being convicted of the kidnapping of their two children, sought the assistance of a cantonal service to protect the children's rights to maintain relationships with both parents. The cantonal authority deemed itself incompetent to proceed with the request. Following this decision, the individual appealed to the cantonal administrative court, which upheld the initial ruling. Subsequently, the individual filed a public law appeal with the federal court against this decision. The court found the appeal to be manifestly abusive and irrelevant due to the individual's prior actions regarding the children's custody, leading to its dismissal as incompatible with procedural standards. Additionally, a request for legal assistance was rejected as the necessary criteria were not met.

Ie COUR DE DROIT PUBLIC

*

11 octobre 2001

Composition de la Cour: MM. les Juges Aemisegger, Président,

Vice-président du Tribunal fédéral, Nay et Favre.

Greffier: M. Thélin.

____________

Statuant sur le recours de droit public

formé par

I.________,

contre

l'arrêt rendu le 28 août 2001 par le Tribunal administratif du canton de Genève;

( art. 36a al. 2 OJ )

Considérant :

Que par arrêt du 3 septembre 1997, la Cour correctionnelle du canton de Genève a reconnu I.________ coupable de l'enlèvement de ses deux enfants, qui séjournent actuellement encore dans un lieu connu de lui seul, et l'a condamné à cinq ans de réclusion;

Que le 21 mai 2001, I.________ a adressé une requête au service cantonal genevois d'application des peines, tendant à ce que cette administration entreprenne des démarches auprès des autorités tutélaires bernoises et obtienne ainsi la sauvegarde des "droits fondamentaux" de ses enfants "à entretenir des relations affectives avec leur père et mère";

Que le service s'est déclaré incompétent;

Que sur recours de I.________, le Tribunal administratif du canton de Genève a confirmé ce prononcé par arrêt du 28 août 2001;

Que I.________ a saisi le Tribunal fédéral d'un recours de droit public dirigé contre cet arrêt;

Que dans la situation créée par I.________ avec l'enlèvement de ses enfants, celui-ci agit de façon manifestement abusive en requérant des mesures de protection à leur égard;

Que la procédure entreprise auprès du service cantonal d'application des peines était, pour ce motif notamment, absolument dépourvue de toute pertinence;

Que le recours de droit public est également introduit de façon procédurière ou abusive au sens de l' art. 36a al. 2 OJ ;

Qu'il est donc irrecevable au regard de cette disposition;

Que I.________ a d'ailleurs déjà usé de pareils procédés (cf. arrêt du 21 juillet 1999 dans la cause 1P.404/1999);

Que le recours est accompagné d'une demande d'assistance judiciaire;

Que celle-ci doit être rejetée, les conditions fixées par l' art. 152 OJ n'étant pas satisfaites;

Par ces motifs,

le Tribunal fédéral,

vu l' art. 36a OJ :

1. Déclare le recours irrecevable;

2. Rejette la demande d'assistance judiciaire;

3. Met un émolument judiciaire de 1'000 fr. à la charge du recourant;

4. Communique le présent arrêt en copie au recourant et au Tribunal administratif du canton de Genève.
