Federal Tribunal Declines Public Law Appeal on Refusal to Sever Criminal Proceedings
Legislator-Zusammenfassung
KI-generiertThe case involved a criminal investigation opened by judicial authorities regarding several individuals accused of false testimony and obstruction of justice following a suspicious death. One of the accused successfully challenged a decision that separated his case from that of another accused, leading to an appeal to the Federal Tribunal. The appellant sought to annul the decision made by the cantonal appeal court, which had reversed the separation order initiated by the investigating judge. The Federal Tribunal considered the appeal inadmissible, stating it did not meet the criteria for grievances that would warrant judicial review at this stage of the proceedings.

KI-generiertThe court imposed judicial costs on the appellant (though the text cites 'art. 66 al. 1 LTF' and the relevant article in force at the time was Art. 66 al. 1 OJ; however, since the dispositive section refers to Art. 36a OJ and not explicitly to a cost article, I must stick strictly to the explicit citations in the dispositive. Upon re-checking the dispositive, the only procedural/cost articles explicitly mentioned are implicitly via Art. 36a OJ which governs the procedure. The payment of costs is ordered implicitly by point 2, but the governing article for costs is not explicitly cited there, unlike the instruction provided in the rule about including cost articles. Since no explicit cost article is listed (like Art. 66 [OJ/LTF]), and no substantive article is applied in point 1, I will list only Art. 36a OJ and Art. 87 OJ used in the preceding reasoning leading to the dispositive.)

jonction de causes; art. 87 OJ
(recours de droit public contre l'arrêt du Tribunal d'accusation du 15 novembre 2001)
Considérant:
Que les autorités judiciaires vaudoises ont ouvert une enquête pénale contre X.________, Y.________ et trois autres personnes, prévenues notamment de faux témoignage et entrave à l'action pénale à la suite d'un décès survenu dans des conditions suspectes;
Que par ordonnance du 19 octobre 2001, le Juge d'instruction a ordonné la disjonction de la cause de Y.________, également poursuivi en rapport avec d'autres faits;
Que Y.________ a recouru avec succès au Tribunal d'accusation du Tribunal cantonal, qui a annulé cette ordonnance;
Qu'agissant par la voie du recours de droit public, X.________ requiert le Tribunal fédéral d'annuler l'arrêt du Tribunal d'accusation, rendu le 15 novembre 2001;
Que, selon l' art. 87 al. 2 OJ , le recours de droit public n'est recevable contre des décisions préjudicielles ou incidentes que s'il peut en résulter un préjudice irréparable;
Que la décision ayant pour seul objet de refuser la disjonction des causes de divers prévenus, afin que tous soient jugés en commun, est une simple étape du procès pénal et constitue donc une décision incidente aux termes de l' art. 87 al. 2 OJ ( ATF 123 I 325 consid. 3b p. 327, 122 I 39 consid. 1 p. 41);
Que cette décision n'entraîne, pour chacun des prévenus concernés, aucun préjudice juridique qu'un prononcé final favorable, tel qu'un jugement d'acquittement, ne supprimerait pas entièrement;
Que les inconvénients matériels inhérents à une éventuelle prolongation du procès ne constituent pas un préjudice irréparable ( ATF 123 I 325 consid. 3c p. 328, 122 I 39 consid. 1 p. 41);
Que le recours est donc irrecevable au regard de la disposition précitée;
Que son auteur doit acquitter l'émolument judiciaire;
