Legislator-Zusammenfassung

The case involves a public law appeal regarding a request for legal aid presented by an individual who was denied assistance by the Cantonal Court. The individual's financial situation was assessed, revealing an annual income significantly above the minimum necessary for living alone in Geneva. Despite being married and expecting a child, the court concluded that the individual did not meet the criteria for being in need of assistance, as he showed no substantial family obligations and had a sufficient income. The request for legal aid was subsequently rejected due to the failure to satisfy legal requirements.

Reeb, Catenazzi,

greffier Thélin.

B.________,

recourant, représenté par Me Vincent Spira, avocat, rue Saint-Ours 5, 1205 Genève,

contre

Vu:

la demande d'assistance judiciaire présentée par le recourant;

Considérant:

Que le minimum vital pour une personne vivant seule, à Genève, correspond actuellement à 13'200 fr. par an, loyer, assurances et autres frais fixes en sus;

Que d'après les renseignements et documents fournis par le recourant, celui-ci ne semble supporter aucune charge de famille effective, alors même qu'il s'est marié en décembre 2001 et que son épouse attend un enfant;

Qu'il dispose d'un revenu annuel (salaire moyen net, indemnités non comprises) supérieur d'environ 22'500 fr. au minimum précité;

Que dans ces conditions, il n'est pas dans le besoin au sens de l' art. 152 OJ ;
