Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Tribunal declared a public-law appeal inadmissible and imposed a court fee of CHF 1,000 on the appellants, upholding the lower court's decision. The appellants had sought annulment of an order that rejected their claim of mandatory recusal of a presiding judge in a criminal proceeding, although the judge had voluntarily recused himself on discretionary grounds. The appellants argued that mandatory recusal was required, which they claimed would allow annulment of the entire criminal procedure and a fresh start. The court held that the appellants failed to demonstrate a legally protected interest (Art. 88 OJ; Art. 90 al. 1 let. b OJ), as they did not show any procedural rule under cantonal law distinguishing consequences between mandatory and discretionary recusal, and they lacked a particular interest in annulling a prior judgment subject to a separate relief request. The appeal was dismissed as inadmissible.

Arrêt du 19 octobre 2004

Ire Cour de droit public

Composition

MM. les Juges Féraud, Juge présidant,

Reeb et Fonjallaz.

Greffier: M. Kurz.

Parties

A.________,

la société B.________,

recourants,

contre

Que le 23 juin 2004, la société B.________ et A.________ ont requis la récusation du Président du Tribunal d'arrondissement de la Gruyère Philippe Valet, en invoquant, à titre de motif de récusation obligatoire, la participation de ce magistrat à une procédure civile parallèle;

Que les requérants faisaient en outre valoir un motif de récusation facultative, en estimant que le magistrat se serait, lors d'une audience précédente, comporté de manière ironique aux dépens du justiciable;

Que par ordonnance du 19 août 2004, la Présidente suppléante du Tribunal pénal de la Gruyère a rejeté la requête fondée sur un cas de récusation obligatoire;

Qu'elle a pris acte en revanche d'une déclaration par laquelle le Président estimait se trouver dans un cas de récusation facultative en raison de "I'acharnement de A.________" à vouloir I'écarter de la procédure;

Que A.________ et la société B.________ forment un recours de droit public contre cette ordonnance, dont ils requièrent I'annulation;

Qu'il n'a pas été demandé de réponse;

Que le Tribunal fédéral examine d'office et librement la recevabilité des recours qui lui sont soumis ( ATF 129 II 302 consid. 1 p. 305);

Qu'aux termes de l' art. 88 OJ , le recourant doit se trouver lésé par la décision attaquée;

Qu'il doit en particulier disposer d'un intérêt juridiquement protégé à I'admission du recours, un simple intérêt de fait étant à cet égard insuffisant ( ATF 129 I 113 consid. 1.2 p. 117; 129 II 297 consid. 2.1 p. 300);

Que I'ordonnance attaquée donne gain de cause aux recourants en admettant la réalisation d'un cas de récusation facultative;

Que selon les recourants, c'est un cas de récusation obligatoire qui aurait dû être admis;

Que l'objet de la décision attaquée est toutefois limité à la récusation du magistrat, les recourants faisant valoir des causes de récusation tant obligatoire que facultative;

Que selon les recourants, l'admission d'un cas de récusation obligatoire aurait permis l'annulation de l'ensemble de la procédure pénale, y compris le jugement rendu les 9 et 10 décembre 2003, ainsi que la reprise ab ovo de la procédure;

Que les recourants se contentent d'affirmations à cet égard;

Qu'ils n'indiquent pas en vertu de quelle disposition du droit cantonal de procédure les conséquences d'une récusation seraient différentes selon qu'il s'agit de récusation facultative ou obligatoire (cf. ATF 119 la 13 s'agissant du canton du Valais);

Que s'agissant en particulier du jugement rendu les 9 et 10 septembre 2003, les recourants n'indiquent pas avoir un intérêt particulier à son annulation, dès lors qu'il existe une demande de relief à son encontre, qui sera vraisemblablement traitée par un nouveau magistrat;

Que, faute de démontrer I'existence d'un intérêt juridique, comme I'exige l' art. 90 al. 1 let. b OJ - applicable également aux conditions de recevabilité d'un recours de droit public -, le recours doit être déclaré irrecevable;

Qu'un émolument judiciaire est mis à la charge des recourants ( art. 156 al. 1 OJ );
