Sexual Offenses Appeal on Arbitrariness of Factual Findings and Presumption of Innocence
Legislator-Zusammenfassung
KI-generiertIn a legal case, an individual was convicted of sexual offenses against minors and sentenced to one month of suspended imprisonment by a police tribunal. Following this, the individual unsuccessfully appealed to the cantonal court, and subsequently filed a public law appeal with the Federal Tribunal to contest the validity of the previous judgment. The appellant argued that the findings of the lower court were arbitrary and violated the presumption of innocence. However, the cantonal court had upheld the original findings, establishing that they acted within their limited review authority. The Federal Tribunal agreed with the cantonal court's reasoning and ultimately rejected the appeal and the request for judicial assistance, holding the appellant responsible for legal costs.

KI-generiertAlthough the text refers to 'émolument judiciaire' (judicial fee) in order 3a, the applicable procedural rule framework for costs in this context, given the date (2001), refers to the structure of the OJ, which governed costs in the decision itself (Art. 66 OJ, though implicitly covered by the explicit cost imposition in order 3a, we follow the explicit article cited in relation to the costs imposed, which is implicitly covered by the cost imposition in order 3, but since no specific cost article is cited next to the imposition, we rely only on the explicitly cited articles in the grounds/procedure. However, since the rejection of legal aid cites Art. 152 OJ, we only include the explicitly cited articles in the grounds or rejection orders: Art. 36a al. 3 OJ, Art. 36a OJ, and Art. 152 OJ).

Que le condamné a recouru sans succès au Tribunal cantonal du canton de Vaud;
Qu'agissant par la voie du recours de droit public, il requiert le Tribunal fédéral d'annuler l'arrêt de cette juridiction, rendu le 26 juillet 2000;

Que le condamné conteste toute infraction et tient les constatations de fait du Tribunal de police pour arbitraires et contraires à la présomption d'innocence;
